  • Jacobs Enforcement officer coming to remove goods at 5pm.

Hi, and thanks in advance for any help you guys might wish to offer. Also I am really sorry if I should have commented else ware instead of creating a new thread.
I had a knock at the door 2 days ago from a Jacobs Enforcement officer he gave me a 24hr notice for removal of goods if I didn't pay the outstanding balance in full (£820) the debt is for council tax and was originally for £510 before they stuck there costs on top. I was shocked as I pay my council tax without fail and currently have 2 attachments of earnings coming out of my wages for last year's ct that comes out every week with out fail for the value of around £50. I rang the council and it turns out I do owe this money but the council refuse to help now as it's with Jacobs. The council told me to ask Jacobs for a payment plan but Jacobs refused as I didn't keep up with it....I never set one up. Jacobs are claiming I rang up and made a payment plan 2months ago...I DID NOT!! So they are liars he said how would we know your. Middle name if you didn't tell us?!? So basically I have to pay in full. Jacobs never turned up after the 24 hrs but they did after 48hrs I never answered the door this time. He hand posted a notice for removal through saying removal 5pm. He shouted through my letter box he was coming in my house at 5pm and instead of causing a scene to open the door. My kids are going to be home at 5pm I'm terrified he's going to break in and scare the life out of them. Yet I don't want to invite that horrible man in. I don't even want to acknowledge Jacobs. I know people say bailiffs can't break in but citizens advice told me they can and will if they have authority to do so...how do I tell if they do in my case?? Thanks guys

Not sure but they even be sending Jacobs, a particularly nasty bunch of charlastans, whilst two AOE are in place? I woulkd ask your local councillor to have a look in, and maybe look at www.turn2us.org to do a benefit calculation to see if you are claiming all entitlements. Are you a single parent? if so have you claimed any single persons CT discount?

What ever you do don't let them in and keep any car out of sight.

2AOEs is this years tax being paid from these or is that owing?
You need to contact Council to check everthing is being paid and if so ask why bailiffs are involved.

Bailiffs can not break in to your house without applying to the courts for permission first!! They can't enter through a window either :tinysmile_twink_t2:
If they have not been allowed entry into your house up to now, then there's not much that they can do. You don't even have to answer the door to them.

          Hi thanks for your reply.
No I am not a single parent (my partner works during the hours the enforcement agents can visit 6-9pm) so unfortunately I have to deal with it. I think I will get in touch with local councillor as I have the 2 AOE in place already.

The 2 AOE are for last years tax. I currently pay directly to my council for this years tax weekly. But yes Jacobs are here for this years tax that I couldnt afford to pay at the start of the year. Ive checked with council and they are receiving the money form my wage and they are reciving my weekly payments fine. I have asked them to take the debt back but they just refuse.

They never turned up last night at 5pm or at all for that matter, he was such a cocky little man I exspected him to be here. It just makes me worry hes of getting a warent to make sure he gets in?!?!? Thanks

As it's for CT, the council have the option to recall the debt at any time (most councils do not like to do this, but there's no reason for you to deal with the bailiffs if you don't want to :tinysmile_twink_t2:

They would only ever be granted a warrant of entry if you were refusing to pay - which you obviously aren't as the council are quite happily taking your weekly payments!!

The threats are just to scare you into paying what they want ... nothing more

Get back in touch with your council and ask them:
                1. How many Liability Orders they have against you?
                2. The dates they were obtained?
                3. The addresses they were for?
                4. The period of time each covers?
                5. How much each one was for?
                6. How much is still outstanding?
                7. The dates they were passed on for enforcement?

They have to give you this information :tinysmile_grin_t:

Contact your local CAB and MP telling them what has been happening with the bailiff, stressing that you are still paying the council weekly for this years CT and have AoEs for the rest. If you have not stopped paying these, then your council should not have employed the bailiffs to start with!!

Write to your council, and the bailiff firm complaining about the harassment from their agent (send letters recorded/signed for)

I was under the impression that as you are paying the maximum via 2 AOE then no further enforcement can take place until such time as 1 of them is paid off.

To be honest it's a bit confusing even the council tell me different things each time I ring the only information that seems to be consistent is that I have 2 AOE in place for CT 2013 between the 2 they take roughly £50 every week. I missed around 3 or 4 months payments at the start of 2014 witch the council say that's the debt that was passed to jacobs. I pay my £21 per week direct to council to cover the rest of the year. The first time I spoke to council they told me there shouldn't be bailiffs involved as I have 2 AOE?!? But further calls to the council they tell me they can take 2 AOE and still use bailiffs as it's for a separate debt.
