  • Andrew Wilson & Co advice needed.

    Hi this i am posting on my husbands behalf.

    Back in 2012 he got took to court, filled his forms in acknowledged the claim and debt as he does owe it. He was ordered to pay on the Judgement for Claimant £4496.85 at £50p/m which he has since 8th December 2012. He shut the company (sole trader) in Feb 2014 and continued to pay march, april and may even though he claimed jobseekers. We wrote a letter explaining he was struggling and missed june, july and august.

    He received a letter 29th August asking him to make the £200 payment which included Septembers by the 8th September, again i sent a letter explaining he had wrote before explaining the financial problems we were having and could we continue with the payments and add the outstanding onto the end of the agreement as i have now got work. They did acknowledge receipt of the letter and we received a reply dated 11th Spetember and said they would act on behalf of their client which we understand totally.

    On Saturday 20th he received a Notice of Enforcement from Andrew Wilson saying he owes £4608.60 + £2.02 interest + compliance stage fee £90 total outstanding £4700.62. When we actually only owed £4496.85 - £900 hes paid = £3596.85 so not sure where the £4608.60 comes from. He has until the 26th September 4pm to pay or arrange a payment arrangement. Then it goes on the mention if he doesnt what they can do and charge.

    Obviously we know he needs to pay this of but 1st they have his figures wrong i do have the Judgment for Claimant form here and 2nd is there a best way to word and email to set this agreement back up as we cant afford anymore than £50. The company was getting into debt and it had to be closed and were still clearing debts that still with this one stand at over £6k now and will be for a while, i just don't want to struggle with the house and family bills/living costs?

      Is this a loan covered by the consumer credit act ? Personal loan, credit card etc.

        Andrew Wilson are a firm of High Court Enforcement Officers and at this present time (and hope it remains to be the case for a very long time) they are not permitted to enforce debts covered under the Consumer Credit Act.

          It's this (in red) I'm finding strange .... the set fee for the Compliance Stage now is £75 not £90!!!!! :tinysmile_hmm_t2:

              No it's for cleaning products he was using for his company, he used to pay cash then he just set an account up for my hubby to make it easier but in the end as the business started to struggle invoices didn't get paid, hubby just stopped buying in the end as as you can see the bill was getting high.

              im not sure what to send in an email to them, as their figures are wrong for the total debt as well, he knows he has to pay this or he can enter a debt repayment plan or bankruptcy but he doesn't want to do bankruptcy, thankfully.

                If you're disputing the amount of the debt then (correct me if I'm wrong please ) they should put action on hold - if they do this, you'd have time to get more advice/sort out a payment plan etc... :tinysmile_twink_t2:

                  Hi kati, your right he's dispiting the amount, just need a bit of advice on how to word it so he can get that sorted and get the payment plan set back up and also do we need to mention the compliance stage?

                    I would mention it - maybe you could ask for a breakdown of their fees too??

                          Email was sent but no reply as of yet.

                          Just a quick question bit irrelevant really, Deane has his Judgement for claimant form, we ordered all his credit files last night as they do need a bit of repairing and sorting we noticed this claim isn't on any of them, i know its maybe not such a bad thing but why would this be any idea?
