    Hello

    I opened a Cap One CC in 1999.

    I stopped paying Cap 1 in Feb 2009.

    CCA request in 2009 only produced leaflets of current T&Cs

    They defaulted me 14/06/2009 with the official default on 17/07/2009 ( so I think they gave the right length of time ).

    Various threatening letters from Cap One and solicitors until 29/01/2010 then nothing until recently when Lowells popped up.

    So I asked lowell for my CCA and Cap 1 for the SAR.

    Both have arrived now.

    From Cap One ( SAR ) , Just the front page of the application . no terms + lots of statements ect.

    From Lowells (CCA ) Front Page of the application and 6 pages ( yes 6 pages of terms and conditions ) copies attached. I have never seen so many pages of T&Cs! I cant believe they ( Cap 1 ) provided me with all six pages back in 1999. More like just one page on the reverse of the application which is not legible now.

    So I think the the application is a copy of the original and the T&C's are reconstituted.

    The writing in the middle of the application is legible ( just ). but its not easily legible ( is this relevant ).

    Million dollar question for PT , would a court say these papers constitute my CCA with Cap 1 ?
