    I have read through this thread twice now so I hope that I have not missed something.

    Firstly, the Magistrate Courts are becoming very tough at the moment regarding the amount of debt that is still owing from court fines that debtors are failing to clear so it will be difficult to get much sympathy from the court.

    On the matter of the Further Steps Notice, there is a legal requirement to send this notice and the court will simply state that it had been sent and it would be difficult to provide otherwise.

    Interestingly, a few days ago I was reading a copy of a long debate from the House of Lords on the matter of Further Steps Notices and it was interesting to read the many comments from the Lords about debtors who may not receive a Further Steps Notice for various reasons...one being that the debtor may have gone on holiday. Interestingly, it was made clear that if a person goes on holiday they would have known beforehand that they had a court fine and should have made arrangements to pay before going on holiday and one Lord even stated that if a person can afford a holiday they should make sure that a court fine is paid first as it is a 'priority debt'.

    What was very clear from the debate is that a debtor knows that they have a court fine and should make sure that they contact the court if they cannot make payment as agreed and to request a 'means hearing' and that they should also contact the court to update them with a new address.

    HOWEVER, the new regulations that took effect on 6th April provide a very significant provision indeed and this is that in cases where 'vulnerability' can be provide (and this includes severe financial difficulty) it is the case that ALL bailiff companies are expected to REMOVE the Enforcement Fee of £235 and 'rewind' the case back to the Compliance Stage and to agree a sensible payment proposal. Surprisingly, this is happening in a lot of cases.

    What is needed is for a suitable letter to be sent to Collectica outlining your circumstances and requesting the removal of the 'enforcement fee' and the agreement to repay the remaining debt at an affordable level. I am very busy for the next two days but will see if I can get something put together for you and will post back.

        I think Milo has answered that. The provisions have changed, so there is an expectation in cases of true vulnerability that the EA will back off and roll things back to the Compliance Stage where a sensible, affordable and sustainable (VERY important) repayment plan can be put into place.

        You are likely to need the Income and Expenditure, so please try to work on that.

          To get a conviction for no TV licence you have to be named presuming you are caught in the property where there was no licence by the Licensing people and have given you name so you would know there is a chance of a Court case.
          Should you fail to attend or if possible plead guilty by post you must face the actions that follow No Excuses.

          The only thing I am against is the involvement of private companies .

            Wales,

            If you read the post there is no intention of avoiding payment. The issue here is getting a sensible balance between the EA wanting repayment (doing their job) and the OP paying it at an affordable and sustainable rate. None of us would want severe hardship in a genuine case of vulnerability.

            I'm all for the tougher approach - there is a job to be done and a fine to be paid at the end of the day.

              I would not want to go 'off topic' but the entire matter of fines for using a TV without a licence is a subject that I am passionate about and you may be interested to know that I started a thread on this subject on CAG last year and it received over 20,000 viewings!!

              This subject is also currently being debated in the House of Commons. However, the current position is that it is still a criminal offence. What the public should be aware of is that there is NO OBLIGATION whatsoever that provides that anyone needs to let a TV Licence Inspector into their home or to even answer any questions.

              The sad fact is that it is those who are ignorant of the legal position who are pursued.

                Until it is no longer a Criminal Offence we must support the prosecution of those without a TV licence why should I and others pay and others get away with it?
                I don't support the Licence idea at all its outdated in the 21st century and would support any campaign to get rid of it.

                By the way I got caught over 30 years ago got fined paid it was not the Fine I feared but my mum finding out SHE did it was in the Local paper.

                  yes I was caught .. yes I was guilty ..I set up a direct debit at the time of caution and have paid it ever since .. I have up to 6 mths prior to that always had a tv licence .I was not in court for the fine to be imposed as it was held 30 miles from my home and I have no means of transport and couldn't afford the 30 pounds it would cost out of my 70 a week benefits . im not disputing the fine .. I took a risk and got caught but I was paying the fine it was a change in circumstances that led to my problem with colectica

                        I called back to thank you all for the wonderful advice given .. I took onboard everything ... I contacted the courts and they pulled the order back and I now pay £10 per week and no longer have to deal with collectica Their charges were also removed and I now can afford to live .. Without this site I don't know what I would of done thankyou to every one who helped me You guys rock XX
