        Sorry had to go out.

        We have a situation now and I'm assuming this is being dealt with under the new rules where EA's automatically appear to be refusing offers of payment at the Compliance Stage. Doing this allows them to add the Enforcement Stage next and charge extra for doing so, there have been many instances of this and believe the MOJ are aware of the practice. Reason being is that £75 gives them nothing whereas the extra £235 does. On top of this it also seems that some Enforcement Co's are now operating "call centres" which is possibly where the text originated from.

        The Council are still responsible for all of this and again I would suggest the OP contacts their local Councillor(s) and makes a complaint about the Council's contractors.

          Definitely get the local member on board, it would appear that one scram has been replaced with another as in refusing affordable payments expressly to apply the Enforcement and the EA hopes £110 sales and Storage fees as well if they Take Control of Goods. rather than the old phantom visit and abortive van fees. Wonder if the MOJ and the Civil Serpents drafting this mess thought of that one.

            Nail on the head BB. One of the most recurring issues since April 6th has been the problem of resolving the debt between compliance and enforcement stages. Judging by internet posts alone, Rossendales are not accepting proposals no matter how reasonable the offer is. I'm sure they are not alone.

            Once a debtor has received a NOE, the clock starts ticking. It is vital to establish if all is in order and if the debtor makes a reasonable offer to pay instalments that is refused, a complaint to the creditor should ensue. Within the complaint, reference should be made to 24 of the National Standards:
            Debtors must not be pressed to make unrealistic offers and should be asked to consider carefully any offer they voluntarily make and where possible refer to free debt advice.

            If the debt is for council tax, further reference should be made to 4.4 of the Guidance to local councils on good practice in the collection of council tax arrears, published by the DCLG:

            4.4 Arrangements should seek to safeguard against bailiffs entering into punitive repayment arrangements directly with bill payers. Local Authorities should consider
            how they manage their relationships with bailiffs to have oversight over such
            arrangements and set parameters for such agreements. They should be mindful of
            the impact that repeat visits may have.

              I would just add, another scam in the same category as above is that the bailiff claims he needs to visit in order to set up a re=payment plan. Usually, if a debtor agrees to this, they will agree to sign a WPA as well. it is possible that a debtor in this scenario will be charged £235 for the privilege of having a bailiff visit to set up the plan.

              These payment plans can, and always should be set up via email or the telephone.

                Which is why the bailiff will insist on coming out, he wants the £235 as £75 isn't enough for a few beers and a kebab on Friday night for the Bailiff
