  • Clarification of appeal process

    I have applied to set judgement aside and stay the writ. I explained this to the EA when he called at my home but he said he has a live writ and wants full payment within 2 days. He claims that it is currently taking 3 months to get a court hearing and his client will not wait that long plus each trip he makes to my home will add a further £100 to his already extortionate fees.
    I spoke to the courts and they tell me it is taking 10 days to review an application. ( I submitted mine 3 weeks ago ).
    If the Judge agrees to set aside , will he stay the writ immediately or do I have to wait for the out come of the court hearing ?

    what is the debt for ??

    As far as I know, if a debt in being disputed, the bailiff can't collect on it ... although I am sure that more knowledgeable Beagles will be along to give you advice too :tinysmile_twink_t2:
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      Until such time that a Stay is granted then the Writ can still be enforced. What you should have done is asked for it to have been treated urgently and delivered the application personally. It appears that your Set Aside will be heard first and if successful then there is no need for a Stay. As Kati says need more info.
