  • Jacobs Enforcement

    today a Jacobs enforcement agent clamped my car, and i had ( well a kind friend did) to pay £300 to remove the clamp I was quite shocked actually and a bit miffed because i was making payments to them to clear this debt, a letter was posted through my door about 3 months ago saying contact such and such to talk about this debt , I saw the chap put the note through the door , by the time i got there he had gone, i then phoned him and asked why he didnt wait, he said well you dont know who your dealing with , he wanted me to pay a £100 a month i said i could no,t he pushed then for £80 and i said that i could not promise this amount each month although i did agree to pay the £80 to get the ball rolling so to speak.
    again i said to him i will pay it each month but can not guarantee that full amount each month. he said try, i the got a letter from Jacobs to say that i had agreed to pay £80 each month to clear this debt, which i did not, so for the past 3 months ive made payments to Jacobs.(what i can afford)
    That's why I was shocked to see them here to day, The 'KIND' friend is a disabled lady and she paid them with her rent money. I feel really awful and told the chap that's how its being paid to them and by whom, i offered to pay on the 8th when i get paid because i am a carer i need then car to take her out. (no blue badge) This was for a parking offence that happened in Bolton with my disabled lady in the car, I dont know Bolton at all, she became poorly so i pulled over to attend to her, I truly did not know i could not stop there, I was there less than 5 minutes caused no traffic problems, which i was doing on the road driving so slowly looking for somewhere to stop,
    I wrote to Bolton council explaining what happened, 6 months later i got the letter from Jacobs, I phoned them and told them what happened, and wrote to the council again, who told me they could not take the debt back, but i should file an out of time claim, which i did, well they did not agree with my statement ( i asked for the original debt to be agreed but not all the extra charges) well they turned my request down.
    Do i have any thing to go by way of a grievance and getting my friends money back and continuing with the repayments or have I lost that right now its been paid many thanks.

        I'm sorry-As I see this, there is very little the debtor can now do.

        Even if there was, now that Jacobs hold the funds, it would take months to get them back by going through the correct channels. By this time, the debtor would have paid the friend back in any case.

        The problem again arises through the debtor failing to communicate with the bailiffs. Simply ignoring Jacobs letter and continuing to pay what you could, gave them the excuse to return. The only thing left for the debtor is to check the fees charged. The £75 compliance and the £235 enforcement fees will be chargeable. If Jacobs have added the sale fee of £110 as well, then there may be grounds to challenge this.

          Was the £300 all that was left of your debt?? Are you now clear of Jacobs Enforcement??

          I'm afraid that I have to agree with [MENTION=40205]The Starving Taxpayer[/MENTION] on this one (see it does happen sometimes :tinysmile_twink_t2 unless you can find any charges that don't fit in with the new fee structure then you will have to put it down to experience :tinysmile_hmm_t2:.

          Will your friend accept weekly/monthly payments to get her £300 back??
