    Hello,

    I know a lot's already been posted on this subject but I'm being cautious and seeking some feedback from seasoned members.

    The above - named have a 2nd charge on my property, originating from an MBNA card balance that I defaulted on back in 2003 or 2004. I finally spoke to someone at dlc and they indicated that although they didn't settle on secured loans that I could still make an offer and they'd "pass it upstairs" for consideration.

    Below is a verbatim copy & paste of the letter I'm about to send with all personal details omitted.

    My questions for the forum users:

    • Will someone give my letter a once - over and give me some feedback, please.
    • Is this communication better off coming from my father, along with the cheque enclosed, seeing as he's the one lending me the money?

    WITHOUT PREJUDICE

    Dear XXXXXX,

    Re: Ref No. XXXXXXXXX

    Further to our recent telephone conversation I am writing with reference to the money which you are claiming on the above account.

    I can confirm that I am unable to offer to pay the money which I owe in full. However, I can raise the amount of £X,000 by way of a private loan made by my father and I want to offer this as an ex-gratia payment in full and final settlement of the account.

    This offer is made on the clear understanding that, if accepted, you will agree to the following:

    • The debt will be deemed permanently settled. Neither you nor any associate company nor any debt collector will take any other action to enforce or pursue this debt in any way and that I will be released from any liability.

    • All defaults and markers will be cleared from my credit files.

    • You will permanently remove the charge held on my property within a period of 7 days from receipt of cleared payment. Discharge papers will be sent directly to HM Land Registry.

    Payment can be made by my father via bank transfer within 48 hours of receiving your written acceptance of this offer.

    I look forward to receiving your reply via email as well as printed post.

      Debt is like any other trap, easy enough to get into, but hard enough to get out of.

          Looks like a good letter to me tho' :tinysmile_twink_t2:

          As for who the letter should come from ... I think as it's your debt, it should come from you. If they query it, then you could always get your father to confirm (in writing) that he is willing to do this for you?? If they accept, then there would be no need for him to confirm, just transfer the money
