    If its not your fault you will get excess back after the insurance company settles with your insurers or you can claim from the Vehicles owner you have the evidence

                    Your own insurers should also claim for your uninsured losses which includes any excess you may have to pay. On the otherhand some insurers will not ask you to pay the excess provided they are satisfied as to the fault of the 3rd party

                    Do you have a legal expenses policy tacked onto your current policy? If so then your uninsured loss claim may be giving to another linked firm who will claim said losses from 3rd party at no cost to you
