  • NHS Discrimination?

A young adult male had to go into hospital for an operation. He was given a notice on which it was stated that the waiting time for that operation is five months for males and just under three months for females. When he asked why there was a difference in waiting time for identical operations he was told that the reason is that there is an additional NHS hospital nearby who treat women only. Surely that is gender discrimination and therefore illegal? I also discovered that a city hospital had an outpatients department for women and children but no outpatients department for men and children and I understand that waiting time in the women's unit is less than a third of that in the general unit. Surely this cannot be legal?

    Re: NHS Discrimination?

The Equality Act 2010 says it’s lawful to provide separate services to men and women if this is a better or more effective way of providing the service.
If the service provider can show they have a good enough reason for treating you differently because of your sex, it's not unlawful sex discrimination.
