  • In need of some help

    I don't know where to turn here is a brief synopsis:

    I have a child with a woman who turns out to start threating me and said child is left with her police advise me to keep away and her to keep away as she was harassing me showing up at my work etc. DNA test ordered by me so i can prove im the daddy and i am

    The child is 7 and was removed from mothers care many years ago for very very bad abuse placed with his grandma (her mom) I have had contact and even had the child stay overnight a few times.

    So now the grandpa has recently died and the mother is taking grandma to court again to get the kids back (She has 4 kids 3 are with grandma only one mine)... this is the ONLy time we have all feared as she is playing dirty and using her dads death as an excuse.

    I am not on the birth certificate but I feel now its relevant due to to the fact if she wins the kids at least i can do something about it... but if im not on the BC i can't do anything its kidnapping.


    SO.... I have filled out a C63 and am ready to take it to a court on monday but any advice i need this done asap i can't allow my son to go back to his mothers care Id upload the social reports if it was allowed but lets just say starvation, malnurishment and burning with cigs were on the report.

    mother REFUSES to have me on the report.

    PLEASE help my son.

    Your child needs his dad ....you need to try to stay calm and collected during the court process (any sign of you losing your temper or even being 'over-emotional' could be used against you ) If the report is taken into account, there should be no way Chilp Protection Services would allow the children to be returned to their mother.

    Keep in close contact with Social Services. Any worries you have about any of the children (not just your son) should be made to them straight away!

    Is there any way you could apply for custody?? You would need to accept Social Worker involvement (at least to start with) but it is always an option :tinysmile_grin_t:

      I'm not sure applying for custody is the best way forward here. Courts usually prefer to keep sibling / half-sibling groups together if possible.

      Unless grandma appears unable to cope (is she very distressed by her husband's death? Is she in poor mental or physical health?) the the simplest and best option for the children would almost certainly be remaining with her and the best option for Lennon would probably be to support this eg provide witness statement about how settled the childrern are and how distressed they would be by any change.

      If grandma can't cope, then the situation is very different.

        Which ever way it goes, I wish him well and hope he stays in contact with his son (and the others if at all possible)

          Discuss with a family attorney may he will help you in more better because most the time they go through the cases like the above. From your side you should have to collect all proof's against that lady that what she did earlier. Prepare witness who will give statement in your favor.
