    Hello,

    hoping someone here can see the wheat from the chaff in a complicated situation:

    I used to have a old style student loan(pre 1998) the majority was paid off but became statute barred several years ago ( over 10) - I started a p/t Degree in 2011 at the OU and had all my financial applications accepted for 3 years - but when I moved to a new Uni to finish my Degree this year suddenly my access to financial help was 'blocked' I only found this out very recently.

    SFE are saying they will block my application for financial support for the rest of my Degree as they claim Erudio a company not connected toi them has a debt i have not paid - there is no debt - this was clarified several years ago when i sent a statute barred notice.


    They appear to have illegally 'sold' a debt to Erudio and are now claiming that Erudio is 'blocking' their attempts to process me as i have outstanding debt.


    How is this possible and where do I stand? i have had no letter from Erudio and SFE are refusing to even confirm with proof that the loan was 'sold' I do not because of Erudio's reputation want to give them my contact details by writing to them especially as i consider myself to have no debt!


    What can i do here? I will have to drop out of Uni unless i can get this sorted for October. Very worried.

    does no one here have understanding or experience with student loans? if not could someone direct me to where I could get specialist advice? CAB has a 6 week waiting list where I am and term will have started....

      Hi Rococo,
      Write to Erudio's credit reference manager, to inform them that the debt is statute barred, and as such, under the limitations act 1980 they cannot enforce payment.
      Ask him to amend the credit reference details as a matter of urgency.
      You may need to send him proof that the debt is statute barred.
      Also write to the original creditor and inform him that by selling on a statute barred debt, they have committed an offence under the limitations act 1980.

        Ive previously been told that a statute barred debt can be sold by a friend - which felt a little 'off'

        if you or anyone else could clarify one more thing? Student Loans are currently blocking my application for disabled grant help because of this - do I have a legal right because of the Disability Laws to say they cannot block my access to disability support?

          Sorry - ive just had another thought - Student Loans said unless Erudio actually tell them the 'debt' has been 'paid off' they will continue to block my application - im presuming that statute barred is not the same as actually officially writing off a debt? so do I need to ask for that? or just stick with statute barred?

            I believe the debt still exists, but the creditor cannot pursue it through the courts.
            Write to Erudio and ask them to confirm that the debt is statute barred, or that they have written it off.
