  • Claim form received - Statute Barred Date?

    Good Morning All,

    I am in England - I have received a claim form regarding an old credit card debt. The issue date is 24th July 2014, which makes the day of service 29th July. My last payment to this credit card was 28th July 2008.

    What date is considered to be the start date of the claim? If its 24th, then the debt isn't statute barred. If its the 29th, then it may be?

    The start date is the date proceedings were issued, not the date they were served.

        So close yet so far..... usually the Limitations date won't start running until a month or two later ie. when the agreement could be terminated, so you'd be pushing it even if the claim hadn't been issued for another few weeks.

        Have you acknowledged service of the claim?
