    Hi

    My fiancee was married in Mexico 15 years ago, the marriage wasn't registered in the UK and she has had no contact with the man for 14 years, are we ok to go ahead and get married (ideally in Mauritius, and have it registered in UK) or are there any legal complications, we would have no idea how to get in touch with the ex, or even if they are still alive!

    Any advice is much appreciated

    YES the marriage is legal! YES she would have to go for a divorce!

    "Overseas marriages are legal in the UK, provided they comply with the marriage laws of the country you have got married in. However, overseas marriage cannot be ‘registered’ here in the UK. An exception to this is where one of the couple is a serving member of, or is attached to, the British Armed Forces at the time of the marriage.     From what I can make out, you should be able to file for a divorce stating that he is a 'missing spouse' - you might be required to put an advert in a newspaper to prove you have actually tried to look for him to serve divorce papers tho'!

      Thanks for your reply, the man in question isn't a Mexican National, he is another Brit, the marriage just happened in Mexico, would we still need to advertise in the paper?

        I would suggest doing it to be on the safe side (unless there are major reasons against him finding her) - she will still need to apply for a divorce tho' so her best bet is talking to a solicitor or getting an appointment at the CAB
