    2. if you're still not happy, refer your complaint to the Financial Ombudsman

    If you're not happy with how the business has dealt with your complaint, you can ask the Financial Ombudsmanto look into it for you. But the business you're unhappy with has eight weeks (longer in some cases) to look into your complaint first - before they can investigate your case.

    You will need to fill out their complaint form and the PPI consumer questionnaire - so that they know all the relevant details about your case. They can help you do this.

    3. PPI complaint form


    • You can fill in the "Word" version of the FOS complaint form on-screen
    • Or print off the "PDF" version of the FOS complaint form – to fill in by hand

    You need to sign the completed form by hand – and post it to the FOS with any relevant papers and documents.

        An update on the Judicial Review on the FCA deadline in yesterday's Times.

        The City regulator has been accused of irresponsible behaviour towards millions of consumers over payment protection insurance compensation by pressing ahead with a two-year claims deadline, despite the move being subject to a legal challenge.

        The Financial Conduct Authority has requested that a High Court hearing over the August 2019 deadline take place in November or December this year. It will start an advertising campaign next month to tell consumers about the cut-off.

        The deadline and a separate ruling by the FCA over commissions on PPI policies is being challenged by We Fight Any Claim, a claims management company. It is seeking a judicial review of the FCA’s policy on the ground that it is “remarkably unfair” to the consumers it has a duty to protect.

        The company, which makes its money from fees on successful claims, wants a judge to decide in the next few weeks whether the case has merit for a full hearing.

        Initial proceedings, known as the permission stage, could take place before the FCA’s advertising campaign begins on August 29. That could give an indication about whether the FCA should still push ahead with it, the company believes.

        Mark Davies, legal adviser to We Fight Any Claim, said that the FCA’s intensions were irresponsible and imprudent because people could rush to make PPI claims, only for a judge potentially to reverse the regulator’s deadline. However, if victims of PPI mis-selling entered final settlements, it could be complex and expensive to change them, Mr Davies said.

        In its response to the legal challenge this week, the FCA argued that there should not be a permission stage and that the case should be rolled up into a hearing towards the end of the year. The regulator says that this will expedite the process and “is confident of vindicating the lawfulness of its measures”.

        The legal challenge will worry banks, which lobbied the FCA to introduce a cut-off date for PPI claims. The mis-selling scandal has cost banks more than £40 billion in redress payments and administrative costs.

        Having said that it was likely to introduce a time limit a year ago, the FCA took until March to make a final decision and announce a two-year advertising campaign financed by banks to raise awareness of mis-selling. Some believe that the regulator used the seven months until March for extra legal consultation to try to safeguard itself against a judicial review.

        Banks hoped that the question of a review would be resolved before the advertising campaign began. However, the dispute between the FCA and We Fight Any Claim has been drawn out.

        The FCA reiterated in papers seen by The Times that its policy “advances the consumer protection objective”.

        There is widespread anger in the financial sector about fraudulent PPI compensation cases driven by claims companies and a strongly held view that consumers know about the issue, so bringing it to an end is reasonable.

            Fight goes on to extend deadline for PPI claims

            Company plans appeal against court ruling

            A compensation claims company has vowed to fight on after it lost the first round of a legal battle to extend the deadline for claiming compensation on missold payment protection insurance.

            A high court judge refused an attempt by We Fight Any Claim to bring a judicial review of the Financial Conduct Authority’s deadline, which will prevent new PPI claims being made beyond August 2019. The Welsh claims company said that it would appeal against the court’s decision.

            PPI has been one of the biggest and most expensive scandals to hit the banking sector since the financial crisis, with £26 billion of compensation paid out so far and just under 20 million policies processed.

            We Fight Any Claim said in its legal argument that of the cases lodged so far, just under 15 million had been upheld and four million rejected.

            PPI has cost financial institutions more than £40 billion including redress payments and administrative costs. The watchdog argued that the proposed deadline for claims would provide “confidence and certainty” for both companies and consumers.

            Claims companies have been accused of encouraging fraudulent demands for PPI compensation and there is a strongly held view in the financial sector that everyone knows about the issue, so bringing it to an end is reasonable.

            An FCA spokeswoman said yesterday:“We are extremely pleased that the court has refused permission to bring judicial review proceedings. Introducing a deadline on PPI complaints is the right thing for consumers.” The regulator will launch an advertising campaign on August 29, exactly two years before the deadline, to alert the public that the countdown has begun. The cost of the campaign will be paid by the banks.

            We Fight Any Claim, which makes its money from fees on successful claims, will have to lodge its appeal before Friday. Mark Davies, legal adviser to the company, said: “The notice of the appeal has been drafted. We believe we have to press on and are going to do that.”

            While most people are aware of PPI, many do not know that they actually paid for it on one of their products, such as a mortgage or credit card, the company argued. Imposing a cut-off for claims would prevent many from seeking redress, it said.

            “Somewhere between 10 and 15 million customers may have the right to redress but they will lose it without ever knowing they had it,” Mr Davies added.

            Mr Justice Singh, who heard the case on Friday, did not agree, saying that the FCA was on sound ground legally.

            An estimated £50 billion of PPI was sold between about 1995 and 2010, or almost 60 million policies to 30 million people, according to the Financial Ombudsman Service.

            The product has come to be widely discredited because in many cases people did not know that they were buying it alongside their loan, or could not have claimed on it because of exclusions, including for pre-existing conditions. If 80 per cent of the remaining unclaimed cases were upheld, the bill for banks for redress plus interest could be between £47 billion and £64 billion, We Fight Any Claim argued.

              It'd be interesting to hear Justice Singh's reasons. Pretty sure the Limitations Act overrides the FCA's admin decisions ? Simplistically anyway.
