  • Equita letter - tax credits help!

    We've just received a letter demanding about £3600 that was overpaid. This overpayment happened about 6-7 years ago. (I had tried to deal with it when it happened but they refused what I offered to pay a month - so I forgot about it- marriage,baby and house move got in the way).

    I rang the HMRC last year asking if I could deal with it through them but they said it was no longer to do with them, that they had passed the debt on. (Another debt collection agency had contacted us last year about it).

    So I'm assuming that agency has passed it on to Equita? Or maybe it's another company belonging to them? Anyway, I'm loathe to pay these greedy buggers a penny as I don't even think that this amount is correct.

    As as it's been bought by an agency, could it be statute barred as we haven't contacted them in so long?

    We're in Northern Ireland, so don't need to worry about bailiffs showing up at the door.

    HMRC does not sell debts to collection agencies.

    There are no Bailiffs in Northern Ireland, but you still have Enforcement Officers From the Enforcement of Judgement Office.

    Bearing in mind that parts of the TGC act effect it as well.

      Tax credit overpayments ARE subject to the Limitation Act so the alleged overpayment could well be SBd: http://www.hmrc.gov.uk/manuals/dmbmanual/dmbm595080.htm :thumb:

      They will say that, but if the DCA fails to collect, they will return the debt back to HMRC as they did with me, I was being chased by Advantis, they returned the alleged debt to HMRC who have now unleashed Akinika, who kept txting me every day. (

      It was probably not sold to the DCA who must be acting on behalf of HMRC (despite what they may have said to you), however, the assignment of debt has no effect on the limitation period. :thumb:
