    That's what I was going to do but kept getting the phone calls and eventually a default notice because I hadn't paid for 3 months. Then I checked my credit report and it was on there so I tried to agree a payment of £10 a month to keep them off my back but they said no because my account would be in arrears. They found out I also have a bank loan and said I would have to pay the full amount as I could not pay one credit lender the full amount and not another so i'm going to have to go in to the bank and ask if i can reduce payments over a longer term so I can pay the full 145 to carnegie consumer finance.

    All in all im screwed and feel there is nothing i can do...

    Wish I hadn't aspired to be a plumber now. Got enough to pay every month.

      Have you made a formal compaint to Carnegie, the FCA and the Financial Ombudsman, it isn't over until the fat lady sings.

      Send a CCA request to Carnegie for starters.

          I think im buggered because other people have said they have not got anthing to say they are paying a loan but my agreement pretty much states i have signed for a "loan" 😠 want to avoid them cus £160 a month is alot but dont want to amounts a debt that will most likely have to be paid back. Wish i could turn back time lol.

            hi iv,e been looking at all the comments and just wondering if eney one had manged to cancel it i having same trouble and want to get at of it apparently i can,t i,m going to citizens advice this week but has eney one manged to cancel it eney help would be great thanks

              Hi lukeboxa

              I know your agreement says you signed for a "loan" but have you checked your credit report to see if it is there? Noddle.co.uk is free to check unlike Experian which is £15-odd a month....

                I checked my credit report on noddle and unfortunately it is there.

                      Okay good, can you post a copy up please. absent of personal details.

                      Ref requesting a copy with the CCA letter, If you request a copy of your credit agreement under s.77/78 of the consumer credit act and they fail to provide it, they are unable to enforce the agreement until such time as they do.

                        I have managed to cancel after paying 7 months (and cancelling the 8th) worth of installments. I asked initially after 5 months and stated mental health and home issues as reasons to stop, they declined stating that I had signed the contract. I tried again in September and included medical letters and an invitation from my doctor for them to contact him and they could pay his fees for doing so. They wrote back highlighting how I had signed a contract but they would be generous and wonderful people and return the money to the loan company and cancel my course (woohoo!). Not sure how this helps you guys still struggling with them, but it's been fantastic to know that it's one less worry for me and money I can't afford to lose is no longer being sucked away...

                          PayAsyouGo ? that's a new one. 08431782678 goes to a generic 'the payment department is now closed' message - I'll try again tmw figure out what this company is.

                          Who are you making the payment's to ? ( who shows up as having taken the DD payments on your statements ?)

                          Yes, your cancellation rights start when you receive the executed copy - do you even know who the 'loan' is with though in order to cancel ?

                            Wow quick reply! It says on my bank statement "MARLBOROUGH INFORM"

                            No i have no idea whether it is a loan or not, i have no paper work stating anything, just the booklets they gave me, i'm assuming its a loan due to everyone else stating that it is a loan..

                            Where do i start from now to cancel? I would like to do it all by letter.

                            To anybody who is trying to cancel, i will inform this forum when i have done it and how i did it, we have been conned unfortunately and it seems they make it impossible to keep track of what is actually going on judging by what i have read.

                              Marlborough are the parent company of Trade Gateway ( and Train 2 GAme, Bright Sparks etc etc )

                              To cancel then you need to write to Marlborough Information Services then ( as they seem to be the creditor )

                              They have FCA permissions as follows

                              So letter of cancellation as you have not received your copy of credit agreement therefore your cancellation period has not started, plus you want to send them a CCA request to ask for a copy of said credit agreement ( http://www.legalbeagles.info/forums/...y-of-Agreement )

                              I'd also make a complaint to the FCA once you have their responses.

                                The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

                                Provision of copy or confirmation of off-premises contracts

                                12.—(1) In the case of an off-premises contract, the trader must give the consumer—

                                (a)a copy of the signed contract, or

                                (b)confirmation of the contract.

                                (2) The confirmation must include all the information referred to in Schedule 2 unless the trader has already provided that information to the consumer on a durable medium prior to the conclusion of the off-premises contract.

                                (3) The copy or confirmation must be provided on paper or, if the consumer agrees, on another durable medium.

                                (4) The copy or confirmation must be provided within a reasonable time after the conclusion of the contract, but in any event—

                                (a)not later than the time of the delivery of any goods supplied under the contract, and

                                (b)before performance begins of any service supplied under the contract.

                                (5) If the contract is for the supply of digital content not on a tangible medium and the consumer has given the consent and acknowledgement referred to in regulation 37(1)(a) and (b), the copy or confirmation must include confirmation of the consent and acknowledgement.
                                Offence relating to the failure to give notice of the right to cancel

                                19.—(1) A trader is guilty of an offence if the trader enters into an off-premises contract to which regulation 10 applies but fails to give the consumer the information listed in paragraph (l), (m) or (n) of Schedule 2 in accordance with that regulation.

                                (2) A person who is guilty of an offence under paragraph (1) is liable on summary conviction to a fine not exceeding level 5 on the standard scale.
                                and

                                Cancellation period extended for breach of information requirement

                                31.—(1) This regulation applies if the trader does not provide the consumer with the information on the right to cancel required by paragraph (l) of Schedule 2, in accordance with Part 2.

                                (2) If the trader provides the consumer with that information in the period of 12 months beginning with the first day of the 14 days mentioned in regulation 30(2) to (6), but otherwise in accordance with Part 2, the cancellation period ends at the end of 14 days after the consumer receives the information.

                                (3) Otherwise the cancellation period ends at the end of 12 months after the day on which it would have ended under regulation 30

                                That should work with Trade Gateway AND Marlborough (if its not a credit agreement)
