    Good Afternoon.
    I will try to make this as brief as possible :
    Purchased a couple of (part leather !) settees from Land of Leather . Encouraged to take 12 month Interest Free Creation Finance .(2006)
    Husband refused to date the doc as he said it would only be 12months on delivery , stating he would sign on delivery. They agreed. Copy of unsigned credit agreement attached to sales and delivery reciept. We ended up not paying the original amount as we had unwittingly gone passed the date of the agreement by a month, what date ? Not signed a credit agreement.
    A second agreement had been drawn up by a member of staff unbeknown to us, signed fraudulently by a memeber of staff (a copy I obtained by a long process and a £1.00 payment) I have both the original and the Micky Mouse copy . I complained to Creation Finance stating the copies did not match and that there was a very large discrepancy. My last written correspondence was Oct 2nd 2007, no money has been paid.
    Outcome; No contact and Debt sold to Lowell

    Lowell , we had Moorcroft, Westcroft etc etc chase us, I refused to acknowledge any correspondence considering the fraudulent action taken and ignored by Creation Finance. A fraudulent signature is not acceptable on a credit agrrement ? If so no contract ?

    Out of the blue a letter a couple of weeks ago from Fredrickson, numerous phone calls , late at night , text messages daily to my husbands phone and a call to his place of work.
    Then this weekend a letter from Bryan Carter with the famous June 24th date I have noticed on other members threads. Legal action may be taken etc.....
    I have all copies of my correspondence up untill the Oct 2nd 2007 and response from C.F.
    My husband has two default cases on his credit record, one from C.F. and the other from Lowell 2010.
    Is this statue barred now or not ?
    If yes, how can I get these bad credits removed ?
    I intend to send a S.B. to Byan Carter, Fredrickson and Lowell.
    Any adivse by any of you in the know would be gratefully appreciated. Thank You

      If there has been no payments or written acknowledgment since 2007, then it would definitely be SBd. :thumb: Do send the letter as soon as you can, to Bryan Carter, as they DO issue proceedings and they wouldn't know the debt is SBd unless you tell them, they wouldn't have statements. :ranger:

      It's not uncommon for Lowell to record a new default when they have a debt assigned to them, using the date of assignment as opposed to the original default date. This is against ICO guidance and you should contact them in the first instance, asking them to amend the record. :typing:

          For reference, this is the updated version of the Principles for the Reporting of Arrears, Arrangements and Defaults at Credit Reference Agencies

          Should your account be sold or referred to another lending organisation or a debt collection agency, the record(s) provided to a CRA by the creditor/and or purchaser must still be accurate and up to date. In all instances you should be told whether and how the information will be reported on your credit file.
          4. If you fall into arrears on your account, or you do not keep to the revised terms of an arrangement, a default may be recorded to show that the relationship has broken down.

          As a general guide, this may occur when you are 3 months in arrears, and normally by the
          time you are 6 months in arrears.
          and
          A default will remain on your credit file for 6 years from the default date.

            Thank you so much Flaming Parrot, I have sent recorded delivery to all three , Lowells, Fredrickson and Bryan Carter.
            I have also contacted a handwritting specialist to confirm the forgery to my docs. £300.00 ! I can see the difference without a specialist.
            If I end up in court ?? I may get justice on this ..... basically it is not a bonifide contract. We will see I will update as and when and again thank you

              Good day, Thank you again for your advise Flaming Parrot.
              I have tracked the recorded delivery of the Statute Barred letters and they were dispatched yesterday.
              I have written today to the Information Commissioner's Office, sending them copies of the two credit agreements and highlighted the flaws in the false document, along with a copy of my other half's signature and date to provide further confirmation of the fraudulent act that we have been subjected to. With hindsight I shoud have gone to the police. I explained that I had contacted them direct as the case was a difficult one and I had previously advised CCF that the credit agreement was fraudulent, I was ignored and my debt sold to Lowells . I allso brought to their attention the DN made by Lowell to the already default account they bought from CCF. Looks like I will have to just sit and wait , :tinysmile_hmm_t2:I will update with any news.

                Well no news is good news ?
                We had the date of June 24th to respond, responded with Statute Barred letters to all concerned.
                The texts have stopped along with the phone calls to the house.
                I think the ICO tried to contact me but missed the call, when I redialing the number I got a polite message, stating the call was of a personal nature and that they would contact me at a later time. Fredrickson and all do not have my mobile number so I presume it was the ICO.
                Fingers crossed the Carter lot have realized nothing they can do.

                  Lowell's have responded to the Statute Barred letter ..........
                  Thanking me for my recent correspondence , advising me that the account is with Fredrickson and I need to contact them directly regarding the query ? The letter they received had both Bryan Carters and Fredrickson's address included as copies sent to all three parties.
                  No mention of its contents ???
                  Is this a normal action from these people ?

                    Recently (about 5 weeks ago ) sent a statute barred to Lowell, Bryan Carter and Fredrickson . Recorded Delivery.
                    Response : Bryan Carter
                    "We have referred the matter to our client (Lowell) and will revert to you as soon as we are in receipt of instructions. In the meantime , we confirm that we have placed the account on hold."
                    Am I to believe that this may be the end of the matter ?

                      BC are just solicitors acting for Lowell, they wouldn't know whether the account is SBd or not, their job would be to send letters to scare debtors into paying and issue court claims. They will have forwarded your letter to Lowell. :ranger:

                      In turn, Lowell probably haven't got a clue whether the account is SBd or not, since they would have bought the account as part of a job lot, without any paperwork or historical data. They would have no clue when the last payment was made, so they'll have to ask the original lender, either that or they'll fabricate a phantom payment to argue it's not SBd, as they have done in the past. :mad2: :mad2: :mad2:

                      For now, no action on your part is required. Do post up if you hear anything from any of them. :typing:

                        I can comfirm that 3 months ago. i was in the same situation.. please see my post for reference

                        i sent the statute barred letter off, and had the same reply

                        it took another 3 months , before i had another letter which i recieved on friday, that the account had been passed back to the client (lowells)

                        So im thinking safe to assume, the statute barred letter did its job

                        hope you have the same letter back as i did

                          Fingers crossed ...... I need to get both Lowell of the credit file stating Default 2010 ??? and Consumer Finance for not taking note that the credit agreement was fraudulent and now SB.

                              Unfortunately a court claim form arrived yesterday. Their last letter was june when the said the matter was on hold. Nothing in writting since . I am having a slight panic attack......Of course I am going to defend it . Please can you advise me what to do . Many thanks in advance .
