  • Bryan Carter issuing litigation proceedings - help much appreciated

    Hi all - new here today, I'm in need of some help regarding a letter I've received today. I'm aware there's a few threads about BC on the site, but I'm hoping I can get a bit of help with mine.

    Today I got a letter from Bryan Carter saying they will be issuing litigation proceedings in the county court, and I'll receive the claim in the next 48 hours. They're acting on behalf of Lowell Financial and telling me they have these fees added on top of the balance.

    I have looked at my credit report and I can see a listing on there from Lowell Portfolio 1 Ltd, with the start date being 25/04/2007, the account was then defaulted on 10/05/2010 (and was last updated on my record on the 17/09/2013).

    I wouldn't say I have much disposable income to get this sorted, if any, but also I don't know what the debt is referring to either.

    I would like to start start a way of getting this sorted. I don't really fancy going to court, or paying back money that has come from ridiculous interest fees and charges, plus I would be able to get to sleep at night. I mucked about with credit when I was younger, and I'm guessing this is from my younger days. I'm certainly more sensible now but as this is my first time of having things like this against me, I would really appreciate some help with this matter so I can stop worrying and maybe relax a bit.

    Sorry if this is a regular occurrence on the board, I do apologise but any help on how to get started and what my steps are would be a massive help.

    As a relative newbie on this forum myself I don't feel qualified to answer your query but do sit tight. The good folks here have answered many of my questions and I am sure will be more than able to answer yours. Good luck.

        It is likely that the claim will arive before you have chance to respond to their letter before action. They seem to ignore the seven days in advance guidance but presumably this isn't the first letter you have received from them or Lowell ?

        If the claim doesn't arrive tmw then have a look at http://www.legalbeagles.info/forums/...any-solciitors regarding responding to the LBA. You can ask them for relevant information preaction and should send a CCA request as soon as possible. Do they not say at all who the original creditor is ?

          Nope, all contact I've had from BC is saying it's from
          Lowell and doesn't say who the original creditor is. My credit record doesn't show anything either.

            So do you have any idea what it could be for? Approx how much are they claiming ?

            These letters usually do turn into court claims so I would try and respond, probably asking what the debt is for starters, and get a CCA request off to Lowell asap.
