  • Aqua CCA help needed

    I recently sent a CCA request and a £1 to lowell they sent me a priority application form which I have signed and 3 statements, I was hoping for all the statements because if this is enforceable I was hoping to claim for credit card charges. Anyway the copies are not very clear but I have uploaded the forms to photobucket, any thought on it please. Has anyone else received this as a CCA.

    I do not know if all the second page is genuine as I have not signed it, it may have been added. I did sign the priority form in 2004 and defaulted in 2010 By the way they never responded with this for 49 days.

    If you want to get hold of all your statements, you'd need to send a SAR to the original creditor rather than Lowell, who wouldn't have all the historical data. :typing: It'll cost you £10.

    Charges would have to be over £12 to be able to reclaim them.

    Not clear at all, I can't read any of the terms on the back. Is that how illegible the copy they've sent you was? Otherwise you may want to try and upload them to the forum instead. Take a look at this thread: http://www.legalbeagles.info/forums/...)&goto=newpost :nerd:

    You'd only have signed the application form not the back page. Hard to tell as it stands, whether it belongs with the form on the front. :noidea: Sometimes there are tell-tale signs on the edges, giving an indication as to the dates the terms apply to, i.e. they could be later terms rather than the ones you allegedly agreed to. Looking at the amounts charged vs the charges quoted can also help. :thumb:

    Can't really tell whether all the prescribed terms are there either due to lack of legibility.

    That doesn't make any difference now they have responded, an account would only be unenforceable due to non-compliance with a CCA request while the request remains in default.

      to be honest my eyes are not the best but I cannot read the copy they sent either, I was really hoping some other Aqua customer may have received one and known whether it was enforcable or not.

            Need a clear picture or scan of the front as well. To see if there is a link or reference to terms included etc that makes them one CCA.

            My gut says not, but just can't tell for sure.

            May just be me as well but doesn't seem that illegible? Just not easy to see on a camera or phone picture?

                Do you know what they should state to make it enforceable, as I have just found another 7 pages of a credit agreement regulated by the consumer credit act 1974, but it has no signatures on it. It is a type up of a credit agreement, I do not ever remember getting it though? And it seems to be about should you lose your card, charges should you spend more, I'm not actually sure what I am looking for.
