      Re: Motormile Pounds Till Payday

      Had a response from MMF
      MMF Response.pdf

I had asked for or questioned the following in my letter

1.Proof of the debt and their right to collect
2.A copy of the notice and deed of assignment
3.Their right to add interest and charges
4.Their right to report to the CRA's with a threat of a complaint to the ICO if they did anything improperly ( I said that any default placed would have to be in line with ICO guidance which would suggest 6 months from the original default with the OC)
      5. Why they had breached the DPA by including details of the account in an email without my consent
6.All communication to be in writing
      7. I did not want to make an appointment with a doorstep collector and removed right of access
      8. That I believed they were members of the CSA and referred them to their code

After receiving the reply I called them to ask if they were members of the CSA and was told they were regulated by the FCA but refused to tell me if they were members

Well do I laugh or cry
This is the letter of complaint I sent, maybe not the best but hey ho
        Letter to Barry Ellershaw1.pdf

This is the reply I got which as expected kind of misses the point.
        scan0001.pdf

Needless to say there is no FOS leaflet . The man is just a bloody liar as I think I have demonstrated. I am about to reply in the same format and include copies of letters and read receipts that prove they first heard from me on 27th May

          Re: Motormile Pounds Till Payday

Had a reply from the CSA who agree with me that they need to discuss some issues with MMF

Anyway today I complained to the ICO and to the FOS with copies of correspondence etc
This is the only way they will learn
Incidentally since my complaint they have updated their website to include such little things as a complaints procedure and membership of the CSA. Obviously only minor details and ones I think they hoped I missed

            Re: Motormile Pounds Till Payday

            Hi

I was using Poundstilpayday for a long time and always paid.
In 2008/09 I didnt pay my last loan as I was swamped and then it went to Clarity for a few months and Ive heard nothing since End of July where Motormile sent me a letter saying I owed £180 and aboyut £450 on payday loans..
After the 2nd letter I ignored but have noticed they've slapped 2 defaults on my experian.
I've raised a Complaint with Experian saying its Fraud BUT is it better to send certain letters to MM to make them remove these defaults.?
The defaults say that there from 30th Jan 2009

            any help will be approceiated.

It was a combination of prove it, in writing only (didn't give my address), no telephone calls, no doorstep and if you place a default I will have your guts for garters . Oh I also said that there was more than one person who used that email address . Lets see what happens now

                Re: Motormile Pounds Till Payday

                Is that your only default?
It will disappear in 6 months so unless the figures aren't correct or there is some other good reason I would be inclined to let it be. I can not believe I have said that
