I've had an unjustified threat from my mortgage company that they may "appoint a Law of Property Act Receiver to manage my property". What are the implications of this? Do they need to go to court to do this?

This the fist mortgage and are you more than three months in arrears.

Not in arrears, or rather we have a court order that allows us to pay off arrears over duration of mortgage from a previous repossession action. All payments are up to date and confirmed by another letter from same organisation.

Do they have to go to court to appoint an LPA Receiver?

I should add that our mortgage is NOT a buy to let, even though the mortgage company are claiming it is, in their letter.

They don't have to go to court to appoint the L.P.A. receiver this is how they circumvent the court process it would help to know who the lender is.

I maby be wrong but I think that as you have a court order allowing you to repay your arrears over the term of the mortgage they would have to go to court
