  • Cumbernauld letter

    I remember reading some years ago, a reference in a textbook to a 'Cumbernauld letter'. (I'm pretty sure that's what it was called).

    I seem to recall that it was a letter that was part Without Prejudice and part not. I have searched for any reference to this, but cannot find it again.

    Can anyone remind me (preferably with a source)?

    I tinks you referring to a "CALDERBANK" letter, which is a settlement letter written without prejudice save as to costs.:tinysmile_grin_t:

      I'm not sure, although I definately recall that the feature was that it was partly Without Prejudice - you inserted a phrase to the effect that 'from this point onwards, this is a Cumbernauld letter'. Is this a feature of Calderbank letters?

      Cumbernauld stuck in my mind because I used to work for a haulage firm and regularly sent lorries there. On seeing mention of it, I remember thinking 'Cumbernauld of all places. Why call it that?'

        Sorry, but I have no further guesses/info that might help your geographic tour of the country!

        There is a lot of info available about Calderbank (sure you weren't sending lorries to the ironworks (closed 1930:beagle2222
        especially following changes to CPR 36 last year (so recent even I remembered )
