Re: HFC / Beneficial formally out of market

Anyway, came across that through Nicholas Wilson ... he's had a response from the FCA on a complaint regarding the collection charges that hfc used to have their solicitors add to debts that went to court - under the pretence that it was allowed for in the terms of contract, which it wasn't, and the OFT stamped on them in 2010. Quite a shocking response from the FCA IMO and really not boding well for the improvement and teeth we hoped for after taking over from the OFT.. http://nicholaswilson.com/fca-confir...-done-nothing/

Quote =FCA. "Prior to 2010, when HFC sent an account to solicitors to recover outstanding debts (e.g. on personal loans, credit and store cards), it added a charge to reflect the costs of the recovery. HFC’s agreements with customers gave it the right to do this and the fee was added after the customer had defaulted on the loan/credit card payments."

    Oft determination in 2010 ... http://www.google.co.uk/url?sa=t&rct...64507335,d.d2k

Which basically tells HFC they must add a term to the contract if it intends to keep charging such a collection charge.
