As unlawful as the initial stop perhaps?

You wait until a copper gets sacked over it. The Police Federation will make damn sure it doesn't happen again and that senior management does not allow itself to be taken in by politically-motivated idiots who are behind such operations.

My gut-feeling is that if those who deal with the fallout from operations like this, like Milo and Fair-Parking, were to approach the Police Federation, which represents police officers from the rank of Constable up to and including Chief Inspector, and the Superintendents' Association, which represents Superintendents and Chief Superintendents, directly and explained the situation to them, I am sure they would listen. After all, the PF and SA represent operational officers, who make up the bulk of warranted police officers. The membership of ACPO is small.

If police officers are found to be acting unlawfully, it is a matter for the IPCC. Greater Manchester Police are already under investigation for corruption - usually unlawful and/or illegal activity - and I can see one of their neighbouring forces being placed under investigation as well.

I can't remember if they would land with a splat or a thud.

But seriously it is a dangerous game the MET play with these bailiffs, and indeed if someone drove off and police initiated a high speed chase to catch them and it went wrong it would not look good as no crime had been committed.

You are absolutely right, BB. I can see MPs asking serious questions if that were to happen. Eric "Pie Eater" Pickles would, I suspect, be hard-pushed to explain it and if Cameron were to try and brush it off with a "Well, they should have paid their debts," I would not be surprised if he became the first British Prime Minister in history to leave the chamber of the House of Commons on an ambulance trolley. I have a feeling right-thinking MPs would nigh on kill the little scrote.

The Met is not exactly a Beacon of Light either, it would be interesting if some of these disgruntled debtors stopped and maybe as they had no money, lost their vehicles, even a work van rendering a tradesman unemployed, banded together in a joint complaint. Whyte & Co showed themselves in a very bad light last night.

You are right as regards a group complaint to the IPCC. These operations raise serious questions of police accountability and whether police officers are acting lawfully. Taking all factors into account, I will stick my neck out and say that any police officer who participates in such operations is running a very real risk of losing their job, if not, facing prosecution for Misconduct in Public Office.

Problem is they don't know they are acting unlawfully, their senior officers aren't likely to tell them.

Doesn't quite work like that, BB. If a police officer knows or suspects an order they have been given is unlawful and querying it makes no difference, then they should report the matter to an officer senior in rank to the officer who gave them the order. They can also report the matter to their Police Federation rep.

I've been watching it also. What Whyte & Co were doing was absolutely and totally illegal. I have no doubt they will bleat about the warrant being enforceable anywhere and then use the distraction technique of banging on about people not paying their debts. Such arguments, in my view, hold no water whatsoever. Any bailiff who takes part in such an illegal operation should have their certificate suspended, in the interim period, pending investigation to establish how many other illegal operations they have participated in, with cancellation of the certificate and forfeiture of their bond to follow. However, it is the civil enforcement companies who organise such operations who should be hit where it hurts most - the company's bank account.

Isn't it strange that none of the drivers claimed their car was on finance therefore "Debbie" couldn't have it?
