  • Mortgage Payment Protection Insurance Claim - PILON/Damages for Breach of Contract

    Hi,

    Looking for some advice around Mortgage Payment Protection Insurance in relation to how PILON and Damages Payments for Breach of Contract are treated.

    I was made redundant in Jan of this year and I'm in process of initiating a claim on my Mortgage Payment Protection policy.

    The insurer has asked if any PILON was made by my employer and referenced that if so a claim cannot commence until the end of the notice period.

    In my case I didn't receive PILON. I received a Damages Payment for Breach of Contract- the breach being terminating my employment early and not allowing me to my right of working my notice period.


    Am I correct in taking the position that in this scenario as I didn't receive PILON the answer to that question from the insurer should be 'I did not receive a PILON' and that my claim should be supported effective from the first day I registered as unemployed (1 business day after my employment termination date) ??


    Many thanks in advance for any advice that can be shared on this.
