    Hello all,

    My Wife's mum passed away a little while ago and left the estate equally to all three of her children. Two out of children are happy to sell the property and split the money equally. however the third and middle child seems to think he deserves all of the inheritance and is resisting all attempts to even go to the probate office. he is not willing to relinquish his responsibility of the estate and also not willing to go to the office, this has been going on for six month and is becoming very frustrating, are there any other avenue we can pursue to progress with the dividing of the estate.

    HELP !!!

    Was there a proper Will?
    Who are named as executors?

      hello all three children are named on the will and all three are executors.

        As all three are executors, you would be wise to consult an appropriate legal professional. Contentious probate is a specialised field and not for the inexperienced, particularly if the removal of an executor is contemplated.

        If you are lucky, a very stiff letter from your solicitor might be enough to make him see sense.
