6 years on...How do I get justice?

    To me my case is littered from start to finish with what should IMO be something any legal type person should be disgusted with and for the sake of all needs to bring to the attention of the rule makers so things like this cannot happen again...No evidence before trial day, not even the right section offence , the CPS`s bullying and disregard for my rights,the judges inability to question me and all else...and the fact I got punished,the one innocent person in that court room that day.I dont really care for compensation even though it would only be fare....I just want an investigation into the CPS`s behaviour and the police to explain there dangerous actions ,and lies about evidence (the video tape that did not exist).

      To be honest you have no hope of getting any of what you ask unless you are willing to spend your money on a specialist Solicitor.

        CPS broke the law. Period. In a motoring case, all evidence the prosecution intends to rely on must be provided to the defendant at least seven clear days prior to the day of the hearing. If this legal requirement is not complied with, the case must be adjourned or dismissed. You were not given a reasonable opportunity to prepare your defence and your right to a fair hearing was violated. Notwithstanding that these particular rights are inviolate and inalienable. Unfortunately, you have found out, the hard way, just how corrupt the CPS is and police officers can be. Thankfully, the percentage of corrupt police officers is normally around 5% of the total number of sworn/warranted police officers.

            Thank you bluebottle...If that is so then I will pursue this somehow.Then again on this alone , this would just create a new trial?? and not deal with the other issues?

              I only would be satisfied when someone from the CPS takes resposability and apolagises and shows a true want for justice to be done...I wont hold my breath.

                  I think crown court...There was one judge,one secretary person and the CPS guy if that means anything...I think magistrates have a few judges? so maybe not that?...there was no one else there in the room...I can go and find the paperwork to confirm if its important?

                    Bluebottle wil know if im wrong but minor motoring offences usually go before a Magistrate.
                    Either way there seems to be a time limit on appeals plenty of info on Government websites

                      Thanks wales01man...but I dont realy want to appeal the judges dicision,if thats what an appeal is...well I want that but I want the original trial investigated too.I will look into those government websites and see what I can find.

                        You are absolutely right, Wales. Other than those motoring offences which fall within the scope of Indictable Offences, the majority of motoring offences can only be heard at a magistrates court. Appeals must be lodged within 28 days of a hearing. Proceedings under the Human Rights Act have to be brought within 12 months of the breach occurring.

                        As for the court hearing, was the judge wearing a wig and gown or a suit? If the latter, it was definitely a magistrates court. District Judges sit alone in a magistrates court. The "secretary person" was a Justices Clerk.

                          Thanks for the info bluebottle...It was a magistrates court,found paperwork...It dont matter now though by the look of it, if the time limit is that above then I may aswell just forget about getting justice.

                            The only way you can find out for definite if there is any avenue you can explore is to seek competent professional legal advice.

                              I think it is for me to appeal to the crown court about the magistrates court...time is an issue like said before but it says this....

                              I need an extension of time for this appeal

                              Only the Crown Court can extend
                              the 21 day time limit for appeal.

                              I need them to extend it about 2000 days...Will try, now just got to work out how to get this form and where to send it...if it is what I need?
