    Hi

    Could use some advise. I have recently defended a claim with Lowell portfolio 1 ltd. I requested the original credit agreement, accounts statements et and all other info be sent through to me to prove it is my debt and how they have reached the final figure. The case has now been referred to my local court for a hearing. The Judgement order stipulates that the claimant had to serve me copies of the documentation upon which they rely to support the claim by the 4pm 29th January. I didn't receive any such documentation by this deadline. I received it on the 30th of January. Dated the 29th January but when posted, not received by me until the 30th. Not signed for either, just through the letterbox, no evidence to say it has been sent and received! I have written to the court to explain the claimant missed the deadline for serving papers and this has been put on the file. My question now is, what do you think the judge will do. Surely if the judge puts stipulations in place, they need to be obeyed, if not, surely there shouldn't really be a case!! Could someone help me with my query. Many thanks

    It's a complicated issue which may see you win or may not depending upon which court is local to you !
