    Hi,

    Please could someone explain how I make the application to the court or is this part of my defence statement or different process ?

    Someone suggested I should submit my defence mentioning that the claimant has not provided requested documents under CPR31.14 and therefore unable to determine if this overdraft falls under limitation period act.

    I would really appreciate some guidance on where I could find a template for my defence as I will need to get this submitted asap.

        for an example - you will need to write your own based on your own situation.

        It is an application made to the court (I'll be back in a tic)

        You need court form N244 http://hmctsformfinder.justice.gov.u...t_forms_id=484

        and there is a court fee attached to submitting it.

          It is a different process. They mention an agreement so your 31.14 request to see it was perfectly valid. They should give you a copy. They haven't. Ask the courts to make them do what they are supposed to.

          s69 interest on a cca debt is a nono.
