Can I claim PPI on my late ex husband's mortgage (joint with me) and loans?

    Dear Legal Beagles

    I'm in a predicament. My husband and I were married for over 20 years and during that time we lived in and had mortgages together on two properties. We also had a car loan during that time. We divorced in 2006.

    He died suddenly in 2010 and I am bringing up our two sons on almost fresh air.

    My question is, am I able to claim ppi on our joint mortgages/loans from that time when we were married?

    It would be beyond helpful at the moment - thank-you x

    I would say this would be unlikely, as any PPI repayment would surely constitute part of your late ex-husband's estate.

    To whom did he leave his money, etc?

      I've just emailed the solicitors who are also the executors and asked them too.
      My sons (who I live with) are the beneficiaries, so I need to make sure any application is legal and fair.

        You could try calling the FOS helpline and asking them - they're usually very helpful http://www.financial-ombudsman.org.u...act/index.html

            They say that patience is a virtue, well, life has thrown some curve balls, but by some sheer luck I remembered this site, clicked on your link for the FOS and they have been very helpful.
            The answer is, yes, I can put forward a ppi complaint for our joint mortgages/loans, even though he has passed away.
            Further to that, the executor of his will is able to put forward ppi complaints on behalf of the beneficiaries - any monies that are awarded become part of the estate.
            Thank-you so very much for your help - it has been greatly appreciated.

                    Ask the executor to check the policies. Loans and mortgages with PPI often had death benefits built in to a higher value and are easier to claim.
