  • Making an application for Unfair relationship Order

    Hello
Could anyone give me advice about how to make an application (under CPR 7B Consumer Credit Act Procedure) for an order under S140B(2)(a)? For example, do I use Application notice N244?
the background is, I made a complaint to a credit card company, who did not respond. They sold the debt to a debt purchasing company, who also failed to address my complaint. I suspended repayments pending a resolution of my complaint. the creditor ( i.e.the company which bought the debt) continued to ignore my letters of complaint, and made a claim against me. The claim was stayed. The judge said that the failure to respond to my letters of complaint was oppressive.
I now intend to make an application for an order under S140B(2)(a) on the grounds that it was an unfair commercial practice for the creditor to make a claim against me rather than responding to my complaint. The remedy I am seeking (under S140B(1)(a)) is repayment of my court costs.
    Grateful for any advice.
