  • [solved] PCN - 12T - Given by conucil

    I have received a PCN from Kensington and Chelsea Council for parking in
    a Private Residents bay WITH Pay and Display ticket. Basically I have
    moved my vehicle one bay to fat and didn't noticed the sign above so
    they have penalised me.

    I have appealed to RBKC as I am unemployed since July 2013. I have
    provided the documents and copy of parking fee that I paid. They don't
    care and enclosed me the form to appeal to Adjudicator to Parking and
    Traffice Appeals Service.

    - Do I have chance to win in ?

    - Is the fact that I am unemployed and don't have any money to pay for
    it is going to be of any use in this argument ?

    Appealing to PATAS will not cost any more than you're liable at the present time (£130?), even if you lose.. If you do nothing it will increase by 50% to £195 and if you don't pay that, bailiffs will eventually clamp your car.

    Other than possibly mis-leading signage, given what few details you've posted, I can't see any grounds for appeal.

    Being unemployed is irrelevant.

    What's the exact location?

      Location of Contravention: Barlby Road, W10 - opposite Exmoor Street

        Won't do any good, adjudicators cannot take mitigating circumstances in account, they can only rule on points of law

          I have sold the car last week as I couldn't keep up with the payments and costs after loosing job.

          I will post the pictures that "CEO" made me.

          There was some work and the ticket machine has been covered by council
          so there had to be some work done in that period. I am really annoyed with this whole situation. Last thing I need is
          a £130 fee for a stupid reason like this...
