  • Advice please. Court case pending

Don't want to mention the date as no doubt Parking Eye will see this thread. However, they're taking me to court for a parking 'fine' that they are not entitled to (as I interpret the law). Can anyone advise me on what to do next or expect on the day? They're actually taking my partner to court despite the fact that they weren't the driver. We never disclosed the driver to them so there is no contract as far as we are concerned.

The event happened after October 2012.

    Thanks

The LB way is for it to be done on the forum. I don't disagree as PE know the claim and will get your defence beforehand anyway. If you still wish to use LB and want privacy then VIP is a good idea.

First thing is to acknowledge the claim which gives you a total of 33 days to lodge a defence.

Then you'd need to collate you letters, particulars of claim, pictures of signage etc and post them up or read read read so you can construct your own defence based on what evidence you have.

Also you should complain to the landowner as you can still succeed with this. http://forums.moneysavingexpert.com/....php?t=4766249

If you think that PE can't chase the registered keeper i suggest you read https://www.google.co.uk/#q=protecti...ule+4&safe=off

They can chase the registered keeper if they follow those rules and this forms the basis of the claim.
