    I remember seeing caselaw a while ago about something similar, will try and find it.

    If my memory serves me well a property was sold privately, without any introduction from the estate agent who the seller had originally instructed, and the estate agent was not entitled to be paid

      It does strike me as odd and unprofessional that they have "suspended their complaints procedure" pending the Court proceedings - one would have thought it should be the other way around. I would have thought the court might also look at things that way. It sounds as if they are not engaging in any meaningful "complaints procedure" at all, just bamboozling. They have obviously been told off about this before (see 1st link below) but the small fine has perhaps not galvanised them into making the "complaints procedure" more effective

        Well how ever so slightly sinister is that? Maybe they're worried about a class action (do such things exist in the UK?) I would imagine a search would home in on this thread (will have a go in a minute!) meanwhile "Hi Ernest Wilson! - think long and hard about the legitimacy of your behaviour......we certainly are :sad:"

                        Hi, i,m sorry to here about this case and not sure if this info can help. 3 of their directrs were fined last year for breaching regulations regarding the way they issue client seller copy of the contract. I recently did a subject access request of all information they hold on me and my business and found the contract they issued to me was different to the one I originally signed. I suggest you check the contract they sent to you! If the contract you signed had the written details on page 1, including the selling price but the one they provided you with has a different 1st page with printed writing `Terms Of Business` on it, it could well be unenforaceable in court. Check yours with a lawyer. Hope this helps.
