  • Notice period after quitting - quick question

    Hi there,

    First post, on the day I quit my job.

    I am wondering about the contractual notice period. I am quite happy to see mine out, because the money would be nice. When does my employer need to tell me by, if they do not want me to see out the notice period (as said, I would rather see it out, if I have the choice)? They have said nothing so far about not wishing me to work my notice.

    Hope this is clear rather than convoluted,

    Hi baboon6

    You are required to give minimum one week's notice if you have been employed for more than one month.

    However, check with your employment contract, as that may stipulate a different time period.

    It would be advisable to go in, unless your employer indicates otherwise.

      Thanks for your reply. I was getting at something slightly different though - if I have a month's notice and am reliant on the money this month will bring, can an employer out of spite say that they don't want me to work that month (thus screwing up my money situation if I don't yet have a new job), or is the notice period protected for the employee as much as the employer?

        If you have a contractual notice period of one month, the employer must pay same, or risk breaching the contract.

        They do not have to supply 'work', though.

        It is usually referred to as garden leave.

          If your contract says that both the employer and the employee have to give a months notice, they have to pay you for the whole month whether, or not, they want you work it. However, if the notice to be given by the employer is less than a month they could give you counter notice.

            Thanks for the replies. Is this true even if I give my resignation within a probationary period of six months? No specific reference is made in my contract to the probationary period having a different period of notice.

              AFAIK, if the contract says 1 month, in the absence of further qualification, 1 month it is.
