  • Redundancy pending

    Hi, wondered if anyone can help!

    I have just been informed my position (marketing administrator) has now become redundant, they have offered me a drivers role, which i cannot do for health reasons, where do i stand with refusing this, also they said they will try and keep me in the company but if nothing becomes available i will be made redundant, what do i do next and can i claim?
    for the last three months all i have done is account work, as my own department do not have any work for me!
    Also been with this company for ten years, five with the marketing department.

          Unfortunately, we had to sack the "Employment Law barrister" we thought we had, when she turned out to be a fake.

                    Hi Gillmadgin,

                    You are quite correct in saying that it is your job which becomes redundant, not yourself as an employee.

                    Have you taken the initiative in identifying any other suitable roles within the company which may be better suited to your circumstances?

                    If there is nothing, then I fear you don't have much choice.

                    The company should, however, make all possible investigations into suitable alternatives, especially in view of your health problems.

                    Whether or not it is a personal issue is not really possible to deduce, but it would be wise to keep a wary eye open for any hint of you being 'capabilitied' out, using redundancyas a convenient method.

                    What is going to happen to the work which you were doing? (The actual day-to-day stuff, not the mere 'title')

                      A common way for companies to get around the above is to argue that the role has changed, which justifies them making someone redundant then getting someone else to do the same job, claiming the role is substantially different. Exactly HOW different the role has to be to justify redundancy is not clear, :noidea: however, one problem you'd have is that, once you've been made redundant, you wouldn't be able to establish what exactly is the role of the person who replaced you, they may just have changed the title. :ohwell:

                        The work has ceased, as this was all paperwork and is now electronic, so the work i use to do is now done by the rest of the team in marketing.with regards to keeping a wary eye open for a replacement, my daughter works for the same company, so she would let me now if and when this happens, how would i stand then if i had been made redundant, then lets say in two months they employ someone who is only doing some of the work i did, how would i stand then, is it a case of I'm out of the company and there is nothing i could do?

                          As things stand, there is little that can be done.

                          However, should you find in the future that the given reason is a sham, you have a possible recourse to an ET claim, as long as it is made within 3 months (less 1 day) from the time that a reasonable person would have discovered the 'porkie'.

                              I was sent home with full pay on monday, this is in the company handbook, they said they were going to keep in touch with me, but no phone call yet! Also the company has covered three temporary post for maternity cover, should they not finish the temps and pass the work over to me? Am i right or wrong?
