  • Am I redundant or not?

    have worked nearly14 yrs at company in question.company changed hands a few times and faced many crisises! got a phonecall 3wks ago to say gone into admin and not to go to work the following monday. Meeting held on the tues (17/7) and told company folded and all 80 or so staff are redundant. We were given forms to claim redundancy and unpaid wages etc. Bummer but at least could focus on jobhunting...then...another meeting called last week. apparantly parties interested in buisiness and we may be tupeed. I have letter telling me I am redundant..????
    Situation is nowpotential new buyer doing due dilignce and still no light at end of bloody tunnel. have interviews lined up. but dont know what to do...Out of work for 3 wks now..no wages..stress is massive
    Any advice appreciated.

    Hi rob68

    Cessation of business is considered to be a fair reason for dismissal.

    However, if it occurs immediately before a transfer of undertaking, this could be viewed as unfair.

    It would be for an Employment Tribunal to decide whether it was reasonable in all the circumstances.

      Have you submitted the forms to the Insolvency Service yet?

      I know of a similar situation where a company was liquidated and then another company carried on with the business from the previous company, but everyone got paid redundancy and any unpaid wages by the Insolvency Service, even though, for a few people, there was no gap in employment, however, those people were not hired as employees of the "new" company (it wasn't a newly formed company) but started working as freelancers.

        Yes I have sent insolvency forms.
        The main issue is there doesnt seem to be a time limit in the gap between companies that you can be tupeed over. We had no wages last month and nothing coming this month..but I still have a mortgage to pay etc. £71 wk jobseekers aint gonna cut it
        Had a really promising interview yesterday and wanna take it if offered. however lower wage and could just get by..but am building massive overdraft in the meantime. How am I supposed to clear that? really frustrated...and what a humiliating experience the chuffin job centre is
        If I knew redundancy pay was sure thing would sleep a little easier.....
