    Hello everyone, my original debt outstanding from a long ago was with lloyds tsb credit card for £4890 , unpaid due to family circumstances and a lack of paid work, was recently passed on to connaught collections, or 1st credit or CAI finance , i have letters from all 3 ,are they all the same company ???? anyway, Moonbeever solicitors have taken over and i have recieved a bancruptcy order form ( B10 notice of registration of a bankruptcy notice) and a court hearing date from them, on behalf of CAI finance,court date 3rd august 13. The proceedings are at the second stage .I was workin out of the country when this was recieved and had no way of responding in the time given. I spoke to MBeever and asked to make them an offer to CAI, they said it wouldnt work and dismissed it but i insisted and made a ridiculous offer to see if they would consider,which was £1000 plus 80 a month. i didnt want to do that , too much financial pressure and they agrreed on the proviso i filled in a statement of means, also companies house says that CAI finance is a non trading company, so how can they issue such proceedings ? . Today i rang MBeever and told them they could be in for a long wait IF i went bankrupt and offered them 30p in the pound instead, i am waiting for them to get back to me , i also asked them for the original credit agreement , i think this fell on deaf ears, does it make a difference having it ?? what should i do if this offer is rejected , i dont want to go bust ,my family and i will lose our home etc , what do i do ??? HELP PLEASE , VERY WORRIED ( i understand this could turn into a lengthy thread but all responses will be very welcome and sorry for any grammatical errors ) thanks, Mark.

    You say you have been working out of the country so does this mean you didn't receive a Statutory Demand in relation to this debt? Were you abroad when the BR petition was served? When did you open the Lloyds credit card account?

      Wait a minute, doesn't a B10 form mean you have already been made BR? Have you checked with the London Gazette to see if this is the case http://www.london-gazette.co.uk/

        statutory demand served on 27th feb 2013 through letter box ( i was on tour working nights in various locations in uk ,i was in newcastle at the time , and could only communicate with my family briefly on every other evening )I arrived home on 24th march) BR petition served 28th may , and was still out of the country , Sweden. Lloyds credit card opened a long time ago probably about 7 - 10 years ago , cannot give exat dates at moment , will find out if possible , thank you

          i am not BR yet ! court date is set for a hearing 2nd august , until then i NOT bankrupt , i am trying to avoid this, i will lose my house etc, i wont let this happen to my family for such an old debt , these finance companies prey on people with little money , i struggle to keep my head above water these days not knowing when or where my next job is but i persevere, fingers crossed there is help out there

            Think you need to get some legal advice quick the DCAs and solicitors will go after you for a debt if you have something they can get the money from,this being your house,you may have little money they dont care if there is equity in your house they can collect the debt and all the fees,caring about your circumstances NEVER money is what they want,
            Get to a solicitor for yours and your familys sake

              This statutory demand CAN still be set aside but you need professional help and quickly. I'm on holiday but if you PM me your details I'm sure I can help.

                  You can only be bankrupted if you owe £750 or more. Can you reduce the debt to £749?

                  This isn't legal advice. See a solicitor for that.

                    I am not sure if you will have to factor in paying the costs of the bankruptcy proceedings on top of the sum in the Bankruptcy Petition, i.e. reduce both to £749 instead of just the latter. Maybe it is just the latter - I do not know.

                    Find out the answer before going to court. As a last resort, if by the time of the hearing you've reduced the debt that you are being bankrupted for to under £750 but haven't paid the costs of the bankruptcy proceedings, and if you do have to also pay the latter to avoid bankruptcy (i.e. to bring it under £750), ask for an adjournment to pay the latter. To avoid the cost of another hearing (i.e. paying for the other side to attend) ask the Judge to state in his/her order that if you do pay it before the next hearing then the other side does not need to attend the next hearing.

                    Obviously the cheapest option is to find out the answer before the next hearing and pay accordingly.

                      It would be the actual debt that should be reduced, however, this is a £4890 debt which, if the OP was able to pay, they'd no doubt have paid!

                      It looks like Cel may well be working on this if the OP sent her the details as requested. ray2:

                            I've just realised that I misread the original post - I thought it said the bankruptcy hearing was on 13th August, hence my very quick post this morning. Instead the hearing was on 2nd or 3rd so it's been & gone.

                              Hello
                              I have today received a B10 Notice of registration of a bankruptcy notice.
                              Im not sure exactly what implications this carries, but does it mean I will loose my house as it says its registered against my property, this was from a tax debt from the year 2000 and I have never had enough money to pay it of or make regular payments.
                              Is their anything I can do to stop them taking my house as Im now worried about this
