  • Statutory demand? - **read here first**

    I work in Consumer Credit Act litigation and I specialise in setting aside statutory demands for bankruptcy. Over the last 18 months, I've successfully set aside over 150 demands and reversed/rescinded several bankruptcies. I also advise on general credit disputes and credit reference matters.

    1. [*=1]Have you actually received the statutory demand yet? If you have received the process servers note, accept the upcoming service politely. Send a brief email to katebriscoe@howlettclarke.co.uk with a bit of background info to help me understand your case.

      [*=1] Once you receive the demand, make a high quality scanned copy. No phone photos, only PDF scans please.

      [*=1]Email the scanned copy to me at katebriscoe@howlettclarke.co.uk. Mark the email Urgent - Statutory Demand Received on XX/XX date.

      [*=1]When you email me your statutory demand, please also supply FULL contact details, name, address, telephone numbers.
      [*=1]These details are being supplied to me in my role at QualitySolicitors Howlett Clarke and will be treated in total confidence and with full legal privilege. You can read about us here

      [*=1]I will then arrange to telephone you to take a full history. Try to remember when/where/how you took out the original agreement and how you got into difficulties.

      [*=1]Is the Central London County Court listed as your court? If so, you will also need to post the ORIGINAL statutory demand to me and extra time will need to be allowed for procedures as the CLCC or RCJ is very strict on originals only.

    As one of Kate's first success stories I can only say that Kate is amazing and is extremely sensitive, caring and extremely talented!! She also walks on water (ok, I might have made the last bit up, but its very close to the truth! - she can turn Stat Demands into confetti!!

    Without Kate's amazing assistance I don't even want to think what position I would be in right now - there was no way I could have won my case without her support and extensive knowledge. The judge in my case openly admitted at the first hearing that she knew nothing about consumer law and gave Lowells/BW Legal a stay despite the fact they had no supporting paperwork to submit to the court and admitted this to the judge. They thought I wouldn't turn up so chanced their luck.


    After this hearing Kate came on board and from that moment onwards it felt like a weight had been lifted off my shoulders. Kate was a whirlwind of excellence and despite BW Legal being real pain in the (insert choice of words!) they were no match for Kate, who kicked them squarely and extremely hard in the (again insert choice of words!)

    If you receive a Statutory Demand my advice is don't hide from it or ignore it. Gather all the paperwork you have (every piece of information you have - anything and everything is important) and ask Kate for help.

    Make sure you work with Kate and respond as quickly and as fully as you can - you are on the same side - you help yourself by making sure Kate has all the information she needs asap.

    Keep calm and trust in Kate - she hasn't lost a case yet and if you work together, you will get a good outcome - Kate is far too caring to ever abandon anybody in their hour of need.

    Personally I'd put Kate forward for a knighthood - she is the fearless defender and protector of those attacked by Lowlifes (also known as Lowells!!)

      Kate was absolutely amazing. I less than 24 hours she had agreed the SD from Lowells be withdrawn completely. Consumer Law is an absolute minefield and I had no hope of actually understanding what I could do to stop any action but Kate advised me honestly and stopped immediate action. I know have more time to finally sort this out legally and hopefully put an end to the worry and stress. I do however strongly feel that the law needs to change with regard to DCA's as their practices are totally unethical!! Thanks again to Kate!!

      I was presented a statuary demand just before Christmas, i was worried sick and having sleepless nights and after seeing what Kate had achieved on the internet, I contacted her.       Kate was exceptionally helpful from the first point of contact, I had many sleepness nights when I received a statutory demand but just one phone call from Kate took all my worries away, she is fantastic in responding to emails and calls and kept me updated throughout the whole process. I did not have to attend court because she won the case to have the statutory demand set aside. I would highly recommend her especially against the bullying debt collection agencies who misuse the court system.

      If you find yourself in debt through no fault of your own and end up with the likes of "low life lowells" trying to make you bankrupt with a statutory demand- then Kate Briscoe is the solicitor for you.

        I was so stressed when I received the statutory demand from Lowell, until I made contact with Kate Briscoe, from the first moment I spoke to her I knew that I had nothing to worry about, Kate was honest and sincere, she explained the process of the SD and was confident that we was going to win, Kate kept me informed throughout the whole process and indeed like she said we did win with all the legal fees paid by Lowell.
