    just got my statement through from the bank and the cheque for the CCA was cashed 28/11/2007
    and the cheque for the SAR for £10.00 was cashed 28/11/2007.

    They have still not supplied either

            Hi SL,

            Just a few questions if I may.
            • When was the original agreement(loan) taken out/signed
            • Does she not have a copy of this anywhere
            • Do you have a copy of any Terms & Conditions for this account(I am thinking mainly about the transferral of the agreement on this question)
            • Could you post up some figures at all, i.e original loan amount, balance outstanding etc
            • PKea, do you have a copy of your agrement that you signed, does everything look kosher?
            IF they have so far refused/failed to send you a copy of the CCA you should be able to send them a letter saying that the account is in dispute and that until such time as a copy CCA is received you will be making no further payments on the account. I am not suggesting that you try getting out of paying the debt but this usually gets them to pull their fingers out of their bums.

              When I did my SAR it was under RFS and they sent everything they had
              cca
              car invoice
              statements
              call logs
              the lot

              But as RCI have taken over, I believe RCI have NO information on old RFS accounts, as i had to send the list of charges to them as they had no record, or maybe this was to try and fob me off

                I will go dig them out,surely everything should have been passed to RCI if they have taken over the account ?

                          These have come out OK.

                          Car finance is a rather specialised area. If you haven't done so already, I suggest you look at Car Credit Complaints - One Community - Unrivalled Support (Powered by Invision Power Board), which is a more specialised site than ours that has very detailed experience of this type of problem and close links with Stephensons Solicitors.

                          They work with LB on some issues and I'm sure they will be pleased to advise. They were a great help to me recently over Welcome Finance.

                          One of their organisers, Bakedalasker, is an LB regular. If you have not yet made contact with them, I suggest you send a PM to Baked and ask him to look at your thread.

                              Thanks for posting those SL it helps clarify things a little.

                              I just have a couple of queries
                              • Did your daughter pay the £300 deposit?
                              • The instalments shown just do not add up ie.
                              1 Payments of £246.89 = £246.89
                              58 Payments of £151.89 = £8809.62
                              1 Payment of £151.89 = £151.89

                              So we have £246.89 + £8809.62 + £151.89 = £9208.40

                              The balance payable (H) is £9307.40
                              The so called total amount payable (I) is £9607.40

                              So there appears to be £99 added somewhere...........or are my calculations wrong? Does the figure of £99 ring any bells to anyone? Hidden commission?

                              I will ask baked to have a look at this one if he hasn`t already.

                                Just as a quick note, have you tried calling them and asking for them to send you a statement, as they have done this for me previously without any problems and it shows all the charges etc.

                                Tools , have you taken into account the credit facility fee of £99, which usually has to be paid with the first installment
