    Hi All,
    My Partner recieved a "you owe - pay now" letter from Aktiv Kapital a few weeks ago, and ignored it as it didn't say what the debt was for or give any information other than "pay up or else yada yada". We have recently recieved another letter again with no information other than they were now offering a F & F of £77 on a £385 "debt" if paid by 22/02/13, we had just ignored this one too, but it's been niggling as to where this "debt" originated. The amount is the same as the one MMF were chasing which was allegedly for a PayDay loan (my Partner has never taken out a PayDay loan - hence why we ignored MMF), but have heard nothing from them since before Xmas - could they have passed it on to AK as they got no joy? I guess the next step would be a "prove it" letter?

    If you are not sure what the debt is for, then you should send a prove it letter. Do not ring them and most certainly don't believe their discount offers. A few years ago I also fell for that old trick with Aktive Crapital who offered to settle a small debt for less than half, I rang them with my debit card, next thing you know I started getting letters demanding the rest. I ignored them and they stopped, but I wouldn't recommend this course of action at all! :nono:

      PROVE IT LETTER
      Dear Sir,


      Your Ref: abcd1234


      You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.


      We would point out that we have no knowledge of any such debt being owed to [insert name of company].


      We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.


      We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.


      Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.


      We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.


      We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.


      We look forward to your reply.

        I see that the Krooks at Aktiv Krapital have threatened to sent round someone to collect your doorstep.

        Unless it is unusually rare and valuable, they won't bother removing it.

          In fact if they did send a doorstep collector, he would be done for criminal damage as soon as he used a pickaxe to attempt to remove it. A doorstep visit is rare, as if one did turn up whilst matter is under dispute, a phone call to the police reporting a bogus official, giving the desctiption of the "collector", and any vehicle they are in will ruin their day. in fact it should pour grunge upon their splod in spades.eep:

                    When Aktiv offer an unsolicited settlement figure of £77 on a £385 debt then that speaks volumes.

                    They are not sure they have the right person, or the debt is statute barred, or it is made mostly up of charges, or it has previously proved to be unenforceable, or something else seriously amiss with it.

                    Prove it letter or ignore. Your call.

                    What is not in doubt is that letter smacks of desperation.

                            - but we have no idea who we allegedly owe the debt to as the letter doesn't give a name, any idea's what I can put in place of a company name?

                            Oh and they can't take my doorstep - we don't have one, we live on the 8th floor lol! :laugh:

                              "We would point out that we have no knowledge of any such debt being owed to "Any finance company, financial institution, credit provider utility, telecommunications company mobile or landline" That should do the trick

                              As you are on the 8th floor, they might not even get to your door, so in the words of JC Denton the character you play in Deus Ex: " What A Shame"
