  • Motormile Finance

    Hi Guys,

looking for some help with Motormouth!
i've had several letters and phone calls since August last year. Recently I received a letter saying that my account had been passed to their doorstep collection team.

i came home today to a hand delivered letter.
Where do I stand with them. I stay in Scotland so not sure about trespass laws. I've never acknowledged the debt and checked my credit file and neither company exist on any off them.

i've just about had it with them as they've ignored all of my letters and emails.

    thanks in advance

Please provide a timeline of events that detail the history of the account so we can see what has happened.

      Thanks for replying

ok, the first letter was received in august, I responded stating that I didn't acknowledge it. i received another letter demanding the payment.

i sent a letter in September asking for a signed copy of a credit agreement as I couldn't see anything on my credit file. I continued to receive weekly phone calls, despite being asked not to.

i received a letter at the start of December stating that my account would be passed to their doorstep collection team.
i sent another letter and two emails stating that they need my permission to attend my property, no response.

i came home today to a hand delivered letter with writing on it stating that they would call again 'if I want them too'

the letter is just a demand for payment

If the doorstepper calls back Tell him to leave. If he refuses contact your local police and report a breach of the peace. Do not get involved in any discussion whatsoever with this muppet. He has absolutely NO LEGAL POWERS whatsoever and no right to be on your property. If you can photograph him and take his car registration number that would be a bonus.

            Thanks both
Kafka - the account belongs to wage day advance, but i didn't open it, nothing appears on my credit file for either account?

When did you take this out?
As ODC says, he has no powers so if he does come back (to quote my dear friend Clever Clogs) ask if he provided his own JCB for the collecting the doorstep and come away from the door.

                      Re: Motormile Finance

Got a bit of history with WDA and motormouth

Contact at WDA is richard.king@wagedayadvance.co.uk I would put in a formal complaint to him stating that you know nothing about the debt

For MM it is barry@mmile.com (barry Ellershaw some sort of customer relations manager)

I have just reported them to the OFT and CSA for saying they are able to collect my doorstep and the law doesn't apply to them and also for implying that if they go for a CCJ they will get one

Keep plugging away, also send a no doorstep letter to them and await their laughable responce.

I have just received an email from these creeps that says "Formal NOTICE OF LEGAL ACTION: unless we hear from you within 7 days on 01138876876. We will rely upon this SMS when legal costs arise. MMF Ref:XXXXXX" How can they take legal action when the debt doesn't even show up on my credit file? Surely if they had any power they would be able to show to other creditors that I have a debt with them?

Was it an email or a txt (SMS)? The legal costs bit refers to the need to issue a Letter Before Action or Letter of Claim before taking legal action, however, an email or text hardly qualifies as such.

There's no obligation to report to the CRAs before taking legal action.

Was this also a payday loan? How much was the original loan and how much are they claiming you owe them now?

I got the same text from these clowns. Its total ******** and legally meaningless, just like themselves. You will shortly get a silly letter from them saying that their 'imaginary' doorstep agents have been unable to contact you so they are now letting their legal department deal with it. Again just another meaningless waste of paper from the Motormouth Muppets.

I hope you haven't been listening to someone on another consumer site. As FP says they do not have to report this to a credit reference agency, in fact I have 1 debt that has never been reported and it's for 17K
I have other debts that although were being paid until about 12 months ago were defaulted 7 years ago and therefore do not appear on my credit file as defaults "fall off" after 6 years but remain active until the statute barred period of no payments or acknowledgements of 6 years have passed (5 in Scotland)
