  • Mackenzie Hall Letter

    Dear Beagles,

    Today I have received a letter from Mackenzie Hall, regarding a "personal matter". I called to ask what this matter was.

    I was asked to confirm my address and postcode, which I did. I was then asked for a former address. I asked why ?

    She then asked if I have ever lived at ****** Road ? I asked why she needed to know (learnt from my dealings with Lowells).

    She asked for a house number and postcode. I said that I couldn't remember, so she said I would have to ring back with these details before she can tell me why they contacted me.

    The road that she mentioned was an address I lived at around 10 years ago, should I therefore ignore any future contact from them ?

      ANY and ALL communication from Mucky Hall should be virulently IGNORED.
      Responses just encourage yet more Bovine Excrement from the Kilmarnock Cowboys.

      Mucky Hall specialise in totally unenforceable and statue barred debts.
      They WILL claim otherwise, and make baseless threats including visits and legal action, but they are full of regurgitated hot air..
      All in all the lowest of the low bottom feeders of the DCA industry..

              Hi have had a letter and a phone call today from Mackenzie hall for a debt with hfc for 6k! We did have this but paid some back but we have other debt collectors calling to for a few other things some we have had settlements on mad r from years ago and some from 7 years ago that we do still owe, we got into this mess as our oldest child was born with extremely complex heart condition and I after working all my life can know longer work as I look after her, my concern is that when I told her on the phone that there was know way I was talking to her or able to make a payment she said she needed a brake down of earnings as my husband works, I told her I don't have to tell her anything as she is a debt collector! She then told me that she is not a debt collector and that they had not bought the debt , they just work for them?? I then said well I still can't pay, she then replied with well if you go through in comings and out going we mite not have to pay anything as our situation may well end up with the debt wiped?? Was she just saying this to try and get me to tell my husbands wage?? I told I had to go and couldn't speak at the time! She said she will ring back tomorrow, do I just ignore this, this debt is 5 years old and was originally for 10k. What can I d0....

                First of all, don't talk to them on the phone, ever! :nono: If you happen to answer and it's them, refuse to go through security and hang up! If they want to contact you they should do so in writing. The cheeky sods have no right to be asking questions about your OH's income!

                What does the letter say? When you say the debt is 5 years old, does that mean this was a loan taken out in 2008? Or defaulted in 2008? Have you been making payments? Mucky Hall are well known for chasing Statute Barred and unenforceable debts.

                If the ring again, there's a letter you can send asking them to stop the harassment, especially if they ring on Good Friday! :mad2:

                Dear Sirs

                Account Reference No: XYZ

                I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of the Protection from Harassment Act 1997 as well as Section 40 of the Administration of Justice Act 1970.

                I ought to draw your attention to the recent Harrison v Link Financial case in which HH Judge Chambers outlined the predatory way in which the account holder was hounded; I quote, from this judgment;

                "Cumulatively and damningly is what I find to be the way that MBNA and the Defendant went about recovering their debt. I am satisfied that the Claimant’s description of the way that he was hounded by his creditors is essentially correct not least in the use of “non-traceable” telephone calls. It seems to me that such conduct has no proper function in the recovery of consumer debt"

                If you continue to harass me by telephone, you will also be in breach of s.127 of the Communications Act (2003) and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you may be liable to a substantial fine and/or other sanctions as they see fit. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

                  Quite possibly, especially considering that she is a proven liar.

                  When did you last acknowledge that alleged debt in writing, or last pay anything toward it?

                  Mucky Hall usually specialise in statute barred debts which they then pretend can be enforced.

                    She tried to call again yesterday and left a voice mail telling me its urgent and i must call her back be fore 4pm! I didn't and don't intend to, the debt has come from a loan in that we had about 8 years ago , unfortunately we defaulted on the payments in 2008 and haven't been able to pay since, I know that sounds terrible that we have never paid it but our life has been turned upside down through unwell daughter. The letter says that we must contact them urgently to stop further action and quote ref, e.c.t! Thank you for your reply to my post as has made me me feel so much better ,also love the song me and hubby did have a giggle :dance:

                      Oh also never have written to them or any one to acknowledge debt, just phone calls. Last payment was Christmas 2008 trough an iva that we canceled as couldn't afford it in the end !

                        Unfortunately, it is not yet statute barred - so either Mucky Hall has somehow (accidentally?) bought a "live" debt or there is some other reason it is uncollectable.

                        Who was the original creditor?

                            Im positive that this debt was with another debt collector before mac hall but originally we took the loan out with HFC , If we hadn't had tried an iva this debt would be over 6 years old unless its been longer than I remember , will have to look at the Ivan paperwork !
