        Current loan £100+ £73+£12=£185If termination sent today they would owe you £3.

        Taking a closer look at the agreement, in my opinion there is no way that a court would enforce the charges, and the prescribed terms are dodgy to say the least. I think they would struggle to get any kind of enforcement order.

        Not that they would go to court of course it isn't how they operate.

              Further to me posts in regards to my issue with this company, I had sent them a letter informing them that the police will be called if they trespass on my property to get collection they did not respond top this and have now sent a second letter saying they will send DCA to my address and issuing a 2nd charge of £100 for costs of sending the DCA.

              The first DCA did not come to my address as i am in all the time as i am currently unemployed, so the first charge is invalid since no when was actually sent.

              This company ignores all corispondance and only calls with recorded messages, i knind of wish they did sent a DCA so i could inform them they are trespassing and the call the police.

                Just had another call which was a recoded message saying i owe them money.

                The laws and regulations that i have noted to date that this company has broken up to now is as follows:

                · Several phone calls with recorded message informing me that I owe them money, no confirmation of whom they are speaking too.
                · Letters threatening to send DCA to address, to which they do not have a license to canvas of premises.
                · Charges per DCA call out (2x £100), these charges are un lawful as they are unable to send DCA as above, also if they was the second charge would be for £60, these are also unlawful as they did not send anyone.
                · They have ignored all correspondence (emails, letters, and calls) with them, calls do not connect and each call they make is a recorded message as above.
                · Debt is for a £400 pound loan and total amount repayable, this I am informed is now at £1200 (2 months since credit agreement).
                · Company does not have a sign on their business premises even though under limited company law they are required to display a sign.

                Its all adding up.

                  Called them today they informed me they have charged £4 per day interest on the account and 3 x £5 per day for failed card transactions for 72 days.

                    is this the same mini credit that has a mr hart as the boss

                    as i remember he got a bloddy nose in court over the charges and he had to withdraw his claim

                        I can tell you now mr hart as not a hope in hell on making the card transaction stick. under the continuous payment authority, you gave mini credit authorisation to debit your card once a month. that was only for one trans action per month, nothing else. if he wanted to debit your card anymore he would have to seek your express authorisation or its fraud

                            So if that is classed as fraud am I able to report them for fraud? I assume i would need to prove this, are banks able to provide the attempts to charge a card?

                              the bank will be able to tell you how many times this company has tried to debit your card. remember, your contractual arrangement with the payday loan company is to debit your card on an agreed date, once, and only once. normally after 30 days

                                Checked the contract and at states they will attempt to debit my card on payment due date, then if that fails they will make to attempts the following day and one more the day after.

                                So even just going off what they have in the contract they can on attempt to debit my card on 4 occasions, which this is definitely fraud.
