    I hope you are able to resolve your issues with your landlord through mediation.
    The credit issue is not one in which we specialise . If you let me know where you are based I will suggest another organisation who will be able to help you with this.

        APR - meaning
        APR takes into account not just the interest on the loan but also other charges you have to pay, for example, any arrangement fee. All lenders have to tell you what their APR is before you sign an agreement. It will vary from lender to lender.

        Ahhh....this explains why my default figure of around £8.5k became over £10k in a year - because 33.3% APR has been added on. Lol.

          Have decided to discontinue this thread and find a solicitor.
          This is because it's too time-consuming, and I'd need legal help, anyway.
          I hope anyone reading finds it useful.

If this is the case then that is a breech of the Data Protection Act 1998. s. 13 I also believe this practice may be breeching certain Courts' Orders' esp. in the Family Courts"

              Illness
              Have been unable even to fill in the LawWorks form for legal help due to extreme tiredness/exhaustion.
              I believe this may be due to thyroid and/or adrenal failure, exacerbated by stress, and will see the doctor for the results of blood tests on 16/7.
              It appears that this condition is also responsible for loss of teeth, and could cause failure of dental implants.

                Applied for legal assistance
                Today I applied to LawWorks for help with this issue.
                To bring aggressive legal action against MKDP/Welcome, sue for damages, apologies, and correction of my credit file.
                It was surprising how quickly I filled in the form, once I started it.
                Although I have not received answer from MKDP/MKRR re my CCA/assignment details request, they said they would reply by 3rd August, and we're nearly there.

                  MKDP failed to respond to CCA request within statutory time period
                  They also failed to reply to letter dated 29th May 2012 by their stated aim of 3rd August 2012.
                  I have had no communication from them whatsoever.
                  Since this was a s 77/78 request for original credit agreement, plus request for account summary, payments statement and assignment details, I do believe the debt is now unenforcable at law.

                    MKDP finally responded to CCA/statements/assignment request today, 17th Aug 2012
                    MKDP responded today to my request sent on 29th May 2012.
                    It has taken them, therefore, 80 days to respond to my request.
                    The letter is at #26 of this thread, here
                    They ask me to accept that the letter as a "final response" to my concern.
                    They say they have raised my "concerns" with Welcome Finance, and have received the enclosed documentation:
                    - Hire Purchase Agreement
                    - Hire Purchase Loan Statement
                    There are two such documents enclosed. The second I have not seen before.
                    They then say I am "liable for the outstanding balance" and that they "will continue with (our) collection activities".
                    They ask me to contact them by telephone and discuss 'repayment'.
                    They then notify me of my right to contact the FOS if not happy with their response, and enclose leaflet about that.

                    Note to self: The Consumer Credit (Enforcement, Default and Termination Notices) Regulations 1983 here

                      However, I spoke Lia Moses 2 days ago, at LawWorks, and she said she has been unable to read through my application as yet.

                      I need to focus on selling my furniture and getting myself rehoused. The month I spent here at Legal Beagles working on this issue put me one month into rent arrears, and I'm being evicted. I don't regret it, as it resulted in a pile of evidence against Welcome and MKDP, and also I want to move back into shared housing.

                      However, I must, regrettably, leave this matter again until I am rehoused as homelessness is not the object.

                        Have decided to file a second complaint through FOS against Welcome
                        Filing through the FOS does not require knowledge of court procedures, and I already have a complaint against MKDP for collecting without licence, marking credit file without licence, using interchangeable names (MKRR and MKDP), etc.
                        Now I will be adding failure to listen to complaint, to produce assignment (etc) docs, to respond to CCA within statutory time period, etc.
                        I will also be filing a complaint against Welcome Finance.
                        The complaints will be linked.
                        The outcome I will be asking for will include, but not be limited to, clearing of my credit file - and YES! The Financial Ombudsman Service CAN do this! They can also award compensation to you, and make the company desist from any further action on your account. They CANNOT, however, force a company to write an apology (spoke to them today).

                        I will be posting any outcomes and results, no matter how long it takes, for others to read, here.
                        Note: the FOS can fast-track any complaint due to serious financial difficulty, ill-health, threatened legal action, or if the business contacts you with an offer. Otherwise, I'm told the process takes around 9 months.

                          FOS have answered, but I'm busy with my housing case
                          For those who have followed this thread, I haven't given up, I'm currently fighting a housing case, trying to keep my home and change the law that gives the right to evict us tenants for no reason - another source of my financial problems - see here.

                          When that's finished, I'll be back and fighting Welcome Finance, and I'll be well armed with my new knowledge of process, and how to claim damages.
