Re: letter from anglian water say i owe £1639.48

I have just rang Anglian Water and the debt is from my previous address
she said that they contacted me by letter in 2007 a year before i moved and Anglian Water was told i had moved in feb 2008 and sent me letters to my presant adddress
i dont remember that far back if they sent me letters but i cirtainly havent had any letters at my presant address before this one
I have asked proof that i owe them this money and asked her to send me all letters/invoies relating to this debt. she said she would get this to me within 5 days
I also asked for a summary letter about me ringing to sort this out which she said she would do
i told her i would contact her in future via email customer service so it is in writting and this helps me also as my memory is terrible
the person i spoke to would only give me her first name and a turrent number ?
she tried to pressure me about the money she says i owe and how i was going to pay it, i was proud of myself and told her i need the information from her first before i talked to her about anything

I am going to panic if i realy do owe this money and such a big amount too
I was working then and for convienience paid everything by direct debit so i just cant understand it

So how many times did you have to drain and refill your swimming pool?

Well done you for not panicing and yes, you did the right thing in refusing to discuss payment until you have proof of debt!!

I would suggest checking your bank statements from the period you lived at your old address just before you moved to see if they showed DD going to Anglican and if they ever stopped. If they do show DD right up until you moved then they would find it hard to prove you owed any money. I think whats likely happened is you forgot to tell them you moved and the money owed may actually be owed by the person that moved in after you moved out - After all if their not being billed for the water and the bills landing on their doormat was in your name, they probably took advantage of it!

Also do you recall cancelling your account with Anglican when you moved out of your old address - If not then its more likely they continued to bill you even if you had stopped the DD, and if you had not stopped the DD, and they were still taking payments after you had moved out, then it maywell be them that owe you and not you owing them!

Also check your credit file if you can as they may have recorded a default on your file. If they have then once you get to the bottom of this and it turns out you don't owe anything. Then you need to demand that they remove the default from your file and threaten to sue them for libel if they refuse.

i will check bank statements and direct debits before i go to citizans advice
i hope you are right but i have an awful feeling that i owe the money
i worked full time nursing back then and was very stressed out and wasnt very good at keeping on top of money matters a year later i left due to illness so if i owe the money i will have to deal with it
i took early retirement and have a small pension to live on so if it turns out that i owe this money i wont be able to offord much.

Puffrose, maths wasn't your favourite subject i take it :tung:

Actually if its in scotland then it would be statuted barred after 5 years - but in england its 6 years.

Well am not exactly puffrose, but am sure she won't mind me answering the question.

Statuted Barred means that a debt can no longer be enforced via court. Though the debt still exists, they can only ask for payment and not take any kind of enforcement action. In Scotland however, when a debt becomes statuted barred the debt also ceases to exist, this is due to different laws in scotland.

                            with pleasure Bambi hun

Statuate barred (spelling?) means a debt that is over 6 years old.
Basically after this time scale, as long as no contact has been made, or acknowledgement of the debt (including payments) your creditor can not take legal action to collect the debt, they can write to you and ask for the money but thats about it.

They will write to you and say oh a collector will call upon you etc but its illegal for them to do so!
