  • disciplinary hearing?

    I had a disciplinary hearing today, After I had raised queries and objections and stated that all the statements and interviews that were gathered in evidence didn't state or even imply the reason given for the hearing my employer adjourned the hearing to gather more statements and to re-interview the same staff! Is this allowed? My letter clearly states that "having fully investigated the complaint I recomend disciplinay action"

      Yes my rights were explained in the letter, the case was me coercing co-workers not to come into work the following day, all the statements and further interviews with staff fail to mention that they were asked/coerced not to come into work or heard me mention any such subject. At the hearing i put this across and the chair agreed with me then said she would have to re-interview the staff and ask them again! surely this is not permitted?

        Why not put a formal grievance* in, asking why a more in-depth investigation was not carried out before moving to a disciplinary, as it could have avoided a very stressful situation, etc, etc.

        Only my opinion, but, faced with an absence of credible evidence, the meeting had to, at the very least, be adjourned.

        That said, it is an implied term in any employment contract is that there is a mutual duty of trust, & the employer does have a right to investigate if there is a reasonable suspicion of breach
