    Hi all and a Happy New Year to everyone.

    Can anyone advise me whether DCA's are allowed to charge interest .... Aktiv Kapital at 15.24 % on this occasion :confused2::confused2:

    ONLY if there is a contractual right to do so, on the whole, nope.

    What is the debt in question ?

      Oh where do I start ......

      This debt was bought from MBNA in 2000. There is nothing signed by either AK or me in a form of a contract to state terms and conditions and interest rates. MBNA sold the credit card debt to AK. I owed MBNA £6500 at that time. I have paid (up till 2007) £3000 then stopped paying due to a disputed (lack of) CCA. They decided then to back date interest charges, todays value of £10,000 remains 'outstanding' according to them. I have recently received back from MBNA (due to a SAR I sent them) note of late payment/over limit charges to the value of £2500 before they sold the debt to Ak. This is a thorne in my side I want got rid of once and for all. Any advice would be much appreciated. Also get regular letters from AK offering to write off the debt of we pay £3500 and they pay £6500 ..... they are taking the p..s. They are hoping I am a cash cow!!!!!
