      Couple of points come to mine regarding nanniealis posts.

      1st re payments, your son has a duty to pay for his son whether he sees him or not, at least thats how the law stands right now. My advice is to pay, however, if he stops she may call in the relevant bodies to make him pay which wont be quite as bad as it seems because they will set a level. This would then put any payments on a proper footing and secure him in this respect. If he does this then he should put money aside each week/month because when they assess him it will be back dated.

      Depending on what hes paying now will depend on how the assessment impacts on him, when it happened to me i was paying more than the CSA would have awarded my ex and therefore they were not interested. On the other side of the coin i was assessed at one stage and after paying all my outgoings and the CSA assessment i was left with £60 pcm. It wouldn't have been too bad i suppose but that was for my food, rent, clothes petrol etc. Hence the start of my debt problems!.

      Anyway the choice is his, but some record must be kept of the money he gives her or he puts it away to give to her so that he can prove he has paid.

      Just a point but whatever he might think about the money and how the mother uses it, the money is actually for his son, the reason i raise this is because i pay for my son now and it often rankles to see what a lifestyle his mother leads versus what my son has and the only consolation is that i pay the money for my son. If she spends it unwisely there is nothing i can do generally.

      I would suggest your son speaks to a solicitor specialising in family law sooner rather than later, if you don't this problem may or may not resolve itself, but it will not go away and so your son needs to assert his right to ensure that he has access for the future. Even if things go wrong if he has the court order sorted out then at least he has that to fall back on.

      I am not sure of the legal aid situation now, but it was available for access cases at one time, the mechanisms by which this is claimed may mean that your son will have to pay it back over time but I suggest that he has no choice but to start going down the legal route.

          thanks just took a quick look and son might be able to get some help.
          He's very angry and upset at the moment so maybe in a week or so i will take him to CAB and then we can try finding us a solicitor to help him
